A. Formal requirements concerning application

Application documents shall be submitted in written form, lawful signed by the applicant via post and additional in digital form on data CD(s).

1) Application documents shall be strictly sorted according to the structure and scheme indicated below, with sections clearly marked by letter index tabs A to L as written in number III.2)

Index tabs A/B/C/E/H/I/J/K refer to minimum criteria. Insufficient fulfilment of any of these requirements will lead to being excluded from taking part in this tendering procedure.

The application shall be send within closed cover which is labelled with the EU-Supplement number, internal registration number (see IV.3.1) and marked as confidential.

2) The application must state to which lot it applies.

3) By submitting the application to participate, the bidder declares its agreement to a change in client. It cannot be excluded that in the course of the tendering procedure a different company of the Vattenfall Group will be appointed as client.

4) The duty to submit certificates issued by third parties (third-party certificates) will become inapplicable if a comparable register does not exist and/or registration is not required. The bidder shall verify this and provide explanations.

5) Within the meaning of the above figure 4, the following bidders are requested to submit comparable third-party certificates. Their equivalents must be verified. In this respect, an exhaustive presentation is expected. In this connection, with respect to item III.2.3), it shall be pointed out that the entire application must be in English, which also refers to the respective verifications and attachments.

If an official document or "third-party certificate" is not written in English a verbal translation of a sworn translator must be submitted.

6) An applicant as a member of a community of applicants may also refer to the capabilities of other companies when submitting its proof of suitability. In that case, the applicant must submit the verifications of items III.2.1) to III.2.3) regarding the other companies, in which the duty to submit references shall be limited to the part of performance to which the other company shall be liable. Furthermore, the applicant shall verify that it has the required funds capacity at its disposal. This may be in the form of corresponding signed undertakings of the company or other companies.

7) The contract-awarding office reserves the right to subsequently request undertakings and verifications (also in the area of minimum requirements). Furthermore, it reserves the right to request a personal interview with an applicant, for example, to verify the independent statements with respect to validity. The applicant has no right to subsequent claims or a personal interview.

8) Noncompliance with the minimum requirements – where appropriate, in accordance with the demand within the meaning of item 7 – shall result in the applicant’s exclusion.

B. Determining companies are requested to submit a quotation.

The companies requested to submit a quotation will be determined in a 3 step procedures, as described below.

a) Formal test (completeness of documentation, including requested verifications and explanations)

b) Qualifying test (fulfilment of minimum criteria; non-compliance to one of the minimum requirements leads to an exclusion from the competition)

c) Assessment (fulfilment of the economical, financial and technical ability and technical equipment for execution of the announced deliveries)

Should more than 8 applicants per lot pass all three fulfilment checks (a, b and c as indicated above), Vattenfall will be allowed to choose the final 8 applicants per lot that best fulfil the requirements. To identify these applicants, the awarding authority will evaluate the stated references in the following points: amount, actuality and comparability of references regarding the subject-matter of the mentioned lot descriptions.

C. Bidding procedure and award of contracts

The actual procedural conditions of the tendering process result from the request to submit a quotation. For reasons of maximum transparency, the contract awarding centre announces general regulations in advance, compliance with which is not required, and therefore appropriations and changes within the scope of the request for bids may by all means occur:

1. In the case of quotations to be submitted at a later time, which – on the basis of surcharge criteria, are economically much less favourable than those of the competition, the Client after placing the tender may decide to exclude the respective bidder from further negotiations.

2. The award of contract is subject to the client’s committee's approval.

3. The time limit for initiating a verification procedure before the contract award committee may be a maximum of 15 calendar days upon receipt of the client's communication not to redress an objection.

D. General information

1. With respect to item II.1.4 the estimated total value of frame contracts are including all possible extension options. The figure is indicative and given as best knowledge by now but without guarantee. In any case the quantity will most likely not be evenly spread over the year.

2. Call off's can be made either by us or by third parties nonated by us to do it in our name.

The application must be signed by all members of the bidding consortium. A lead member must be named. The member's power of attorney must be submitted. Statement of the bidding consortium must include that the bidder community is constituted as a body with joint and several liability. The internal organisational structure of the bidder community must be presented and explained.
