1) The applicants must note that the application form is signed by them in a legally effective way and that all declarations and documentations stated in the publication are enclosed in their entirety. References to prior applications are not sufficient. Mandatory statements, i.e. required to be submitted, are marked with “minimum requirements”.
1a) Applicants who do not document the minimum requirements with their application form are excluded from the ongoing procedure.
1b) Application forms not including the other requested declarations and documentations may be excluded. The awarding office reserves the right – without being obligated to do so or without the applicants being entitled to this – to subsequently request declarations and documentations.
2) The application form must be submitted in written form in duplicate (1 original and 1 copy) and in electronic form on a data carrier (CD). The application form must be submitted in English language, in a sealed envelope by mail or directly. It must be marked as such by stating the EU publication number, designated as “confidential” and include the sender’s data. Application forms which are exclusively submitted in electronic form cannot be processed and will therefore be excluded. Application forms which are not addressed correctly and immaculately and which are therefore not received in time at the address stated in Annex A, Item III, will be excluded.
3) Foreign applicants must submit the corresponding register excerpts, documentations, certifications and declarations in accordance with the legal regulations of the country in which the company is registered, translated into English, and prove their equivalence.
4) For the purposes of the above Clause 3, foreign applicants are required to submit comparable third-party documentation. All information necessary to demonstrate comparability is expected. In this connection, with regard to Clause VI.3.2 of the announcement, it is to be noted that the entire application must be in English, including particular verifications and attachments.
Should an official document or reference etc. not be originally in English, a literal translation by a sworn interpreter must be submitted.
5) All documentations, excerpts and certifications must be proven to be current and valid.
6) The awarding office will review the application forms in a three-level procedure: 1st level: review of the submission of requested documentations and declarations, 2nd level: existence of grounds for exclusion in accordance with public procurement law (“minimum requirements”), 3rd level: review of the economic, financial as well as technical capacity, measured by the service to be awarded.
If examination shows that more than 5 applicants meet the requested requirements, the office awarding the contract reserves the right to select those applicants which best meet the suitability requirements for submitting proposals.
For evaluation, three references must be submitted on the performance of comparable services.
If more than three references are submitted, the applicant must clearly mark the references that are to be evaluated.
Otherwise the client will evaluate the first three references named.
Comparable services include in particular information on the areas of.
— structure and function of nuclear power plants with boiling water reactors and their systems,
— physical and thermohydraulic processes in the reactor core,
— operation and monitoring of reactor cores.
Required information for references:
— name and address as well as the name of a contact person with telephone number,
— designation of the reference object,
— order value,
— period of service provision,
— description of the service in technical terms as well as scope of the services rendered,
— any letter of recommendation.
The evaluation will be scored as follows: per reference submitted for the areas given
0-2 years = 11 points, 3-4 years = 8 points, 5 years = 5 points, > 5 years = 0 points
Once the individual references have been evaluated, an average score will be calculated as follows: points divided by the number of references evaluated.
The applicants will then be ranked according to their average score.
7) When submitting the application, the members of an applicant community must appoint one of their members as their authorised representative for the awarding procedure (including any potential review procedure) up to the awarding of the contract and commit to be jointly and severally liable. The awarding office reserves the right to verify the legitimacy of the applicant community in terms of antitrust regulations. Upon request, the applicant community shall prove its antitrust compliance.

2) Declaration stating that no person whose conduct is to be attributed to the company (e.g. the managing director) has been issued a final sentence on account of a violation of any of the provisions in § 21.1 SektVO (German Ordinance on Awarding Contracts in the Areas of Transport, Drinking Water and Energy Supply) or comparable punishable offenses in other countries (minimum requirement)
2) Declaration stating that no person whose conduct is to be attributed to the company (e.g. the managing director) has been issued a final sentence on account of a violation of any of the provisions in § 21.1 SektVO (German Ordinance on Awarding Contracts in the Areas of Transport, Drinking Water and Energy Supply) or comparable punishable offenses in other countries (minimum requirement)
3) Applicants must demonstrate in a suitable form that none of the buyer's competitors holds shares in them or is in any other way legally affiliated with them or owners of them, in whole or in part.

4) As far as the applicant and/or applicant community is unable or unwilling to provide the service described itself (Support for the physical and thermohydraulic design of reactor cores and core components and for operational support for the Brunsbüttel and Krümmel nuclear power plants), it must submit and document in its application which company/companies will be at its disposal for the provision of these ordered services in a binding way, and submit the aforementioned declarations and documentation for this/these company/companies (“minimum requirement”).
4) As far as the applicant and/or applicant community is unable or unwilling to provide the service described itself (Support for the physical and thermohydraulic design of reactor cores and core components and for operational support for the Brunsbüttel and Krümmel nuclear power plants), it must submit and document in its application which company/companies will be at its disposal for the provision of these ordered services in a binding way, and submit the aforementioned declarations and documentation for this/these company/companies (“minimum requirement”).

1) Presentation of the company profile including information on the economic situation of the applicant (in the case of a public company the latest Annual Report, in the case of other legal forms equivalent documentation)
2) Declaration on the applicant’s total turnover and sales in the last five business years maximum, with regard to services comparable to the service to be awarded; information on an annual basis
3) Documentation of tax payments in the country in which the applicant is registered
4) Documentation of social-contribution payments (pension, unemployment, health, nursing and statutory accident insurance) in the country in which the applicant is registered
5) Declaration by the applicant that no insolvency proceedings have been initiated or filed and that no proceedings have been initiated or filed on account of any insolvency or comparable proceedings on the applicant’s assets, and that no petition has been denied for lack of assets, either. Should such an event occur at a later point during the ongoing awarding procedure, the awarding office must be informed immediately (minimum requirement).
