It might be possible that a new corporate entity will be established for this wind farm development. In this case TWB will transfer all rights and obligations of this public procurement and/or of the contract to this new corporate entity. The bidders will have to accept that. The bidders will be informed if a new corporate entity will be established. The award/conclusion of the contract depends on the secure financing and the confirmation of the shareholders of the contracting entity. It might be possible that the contracting entity reduce the number of bidders to secure an appropriate relationship between the features of the procurement proceeding and the corresponding expense.

— provision of

(i) bank reference regarding the financial and economic capacity, not older than 2 month referring to the date of the request to participate,

(ii) annual reports of 2007, 2008, 2009 and 2010 (if 2010 is already available),

(iii) number of employees.

— confirmation of the company management that no insolvency proceedings or comparable proceedings in regard to the company exist and the obligations to pay tax and social security contributions are fulfilled. The contracting entity may require an updating of this confirmation.

Technische und berufliche Fähigkeiten:

— references of contracts in the last 3 years, which are comparable to the present contract,

— details of experience and education of personnel who shall be assigned to key project management and technical rolls,

— conformity to current management standards for quality (EN ISO 9001 or equal) environmental (EN ISO 14001 or equal) and safety (OHSAS 18001 or equal).
