RWE Innogy Nordsee 1 GmbH has decided to perform a formal procurement procedure solely in order to create a maximum degree of transparency and competition. RWE Innogy Nordsee 1 GmbH is not a contracting entity pursuant to Art. 2 of the Directive 2004/17/EC and to § 98 German Act against Restraints of Competition (GWB). Therefore, RWE Innogy Nordsee 1 GmbH is not bound to the Directive 2004/17/EC, the German Act against Restraints of Competition and/or the German Sector Regulation (Sektorenverordnung). These regulations solely serve as guideline for this procurement procedure. Furthermore, the candidates/ bidders do not enjoy legal protection under the Directive 89/665/EEC and/or the German Act against Restraints of Competition. This negotiated procedure is divided in 2 parts: First, RWE Innogy Nordsee 1 GmbH will evaluate the requests to participate on the basis of the following criteria: commercial, technical capability, organizational capability and HSE/QAQS. After this, RWE Innogy Nordsee 1 GmbH intends to select the 3 to 6 most qualified candidates in order to invite them to submit their tenders. Secondly, RWE Innogy Nordsee 1 GmbH will evaluate the tenders and negotiate with at least three bidders. The bidders are not entitled to participation in the negotiations. Furthermore, the contract award is subject to the approval of the conclusion of the contract by the management of RWE Innogy GmbH. In the individual case, the conclusion of the contract may also be subject to the approval by other committees of RWE AG.

Offshore Windfarm Innogy Nordsee 1 is situated approximately 32 km north of the island of Juist between the traffic separation area Terschelling-German Bight und German Bight Western Approach.

Bedingungen für die Teilnahme
Befähigung zur Berufsausübung:

1. The candidate and every member of a bidding consortium has to submit Company Information (informational);

2. The awarding entity will excercise a compliance check on the candidate and its organs as well as on every member of a bidding consortium (informational);

3. Confirmation that the candidate and its organs have no record of successful court actions against them involving fraud, corruption or other major breaches of the Companies Act or similar law in an EU Member State. Every member of a bidding consortium must submit this confirmation. Any successful court action will lead to the exclusion of the candidate. The same applies to the event, that one member of a bidding consortium or its organs have a record of successful court actions. In that case, the whole bidding consortium will be excluded. (knock-out criterion);

4. In case of application as a bidding consortium, the bidding consortium must confirm joint liability for the execution of the total contractual obligations. Furthermore, the bidding consortium has to nominate a lead bidder as representative of the bidding consortium for the tendering procedure (knock-out criterion).

Wirtschaftliche und finanzielle Leistungsfähigkeit:

1. Details of already signed contracts for 6 MW WTG class (wind turbine generators) currently in progress (score);

2. Copies of published accounts for the past 5 years (score);

3. Capacity - value of work the candidate would undertake (score);

4. Capacity - value of work the candidate has undertaken (2008 - 2012) (score);

5. Levels of insurance cover currently held (score);

6. Has there been, or is there likely to be, any substantial change in the financial affairs of the candidate since the closing date of the named accounts which may affect the ability of the candidate to successfully carry out the contract? (score);

7. Confirmation, that in the event of the award of the contract the RWEI code of conduct will be complied, a confidentiality agreement will be contracted, damages for delay will be awarded and a performance bond and a parent company guarantee will be provided (Knock-out criterion).

Technische und berufliche Fähigkeiten:

1. List of wind offshore projects the candidate has been in charge of, distinguished between projects in the Exclusive Economic Zone and the Baltic Sea. Details of the scope of work for these projects (score);

2. Experience regarding the design and production of WTG with an output power of 6 MW and more, including nacelles, towers, hubs, blades, HV/MV-switchgears, protection systems, SCADA- and communication system (score);

3. Description of WTG production facilities and the level of subcontracting. Description where the production facilities and main component suppliers are located, and the output level of produced WTGs per month (score);

4. Offshore experience regarding the installation of wind turbine generators, list of installation teams and equipment used and the level of subcontracting (score);

5. Offshore experience regarding the commissioning of wind turbine generators, list of commissioning teams and equipment used and the level of subcontracting (score);

6. Description of standards which comply to the product (informational);

7. Experience and capability in execution of offshore wind turbine generators design. Description of the level of subcontracting if needed (score);

8. List of software name, the software version, the number of available licenses. Description whether the readiness to submit the calculation tools and models. Description of modelling software and whether the candidate is able to perform 2D and 3D modelling (score);

9. Description of the computer hardware (score);

10. Company organisational structure (informational);

11. Office locations (score);

12. Description of the entire scope of work/ service the candidate provides (score);

13. Description of design and production capability and capacity and manpower (external/internal) (score);

14. Confirmation concerning availability of the relevant resources (knock-out criterion);

15. Description of project management structure and organisation incl. planning, monitoring and control mechanisms or procedures employed. Details of project management system (score);

16. Details of quality management certification (score);

17. Description of quality management system which provides quality assurance of design and production (score);

18. Confirmation concerning statutory personnel policies in place to ensure all personnel have equality of opportunity within the workspace (knock-out criterion);

19. Confirmation concerning the ability to communicate in English and German language written and spoken at commercial and technical levels fluently (knock-out criterion);

20. Confirmation concerning the ability to provide all documents concerning the execution of the awarded contract in German and English (knock-out criterion);

21. Description of HSE/QAQS Policy and statistics. In case of application as a bidding consortium, every member must submit the named information (score).
