Construction Insurance including Third Party Liability and Delay in Start-Up for the Nordsee One GmbH offshore wind project. Nordsee One GmbH offshore wind project will be a 332 MW wind farm in the German North Sea. After the prequalification of Tenderers, it is expected that the Tender submission material will be available electronically between December 2013 - January, 2014. According to schedule the quotes should be submitted February, 2014. The exact date and activity plan will be available in the Tender Submission material. The evaluation of tenders will be made immediately hereafter, and negotiations, if any, will be held. After the selection of the lead Insurer, negotiations with following markets will be made in order to have the final insurance program in place no later than the end of February, 2013. More specific details about the procedure will be made available in the Tender Submission Material.

This is a voluntary contract notice Nordsee One GmbH has decided to perform a formal procurement procedure solely in order to create a maximum degree of transparency and competition. Nordsee One GmbH is not a contracting entity pursuant to Article 2 of the Directive 2004/17/EC and to Paragraph 98 German Act against Restraint of Competition (GWB). Therefore Nordsee One GmbH is not bound to the Directive 23004/17/EC, the German Act against Restraint of Competition and / or the German sector regulations (Sektorenverordnung). These regulations solely serve as guidelines for this procurement procedure. Furthermore the candidates / bidders do not enjoy legal protection under the Directive 89/665/EEC and / or the German Act against Restraint of Competition.

Regarding associations of companies / business units (consortia), the proof of the right to exercise insurance duties shall be provided for each economic operator / company. Wirtschaftliche und finanzielle Leistungsfähigkeit:
1) Latest rating from an approved Rating Agency, see C262/12 list of credit rating agencies registered under the European Parliament and Council Regulation (EC) No 1060/2009 on credit rating agencies. Regarding associations of companies/ business units (consortia) the data in section 1) shall be provided for each company / business unit. The tenderer must have a rating of at least A- by Standard & Poor's or Fitch or the rating A3 by Moody's or equivalent rating from an approved rating agency, cf. C 262/12 list of credit rating agencies registered in accordance with European Parliament and Council Regulation (EC) No 1060/2009 on credit rating agencies. Regarding associations of companies / business units (consortia) the minimum requirements must be fulfilled by the companies / business units combined. If the economic operator of a valid reason is unable to provide any of the contracting authority, he may prove his economic and financial standing by any other document which the contracting authority considers appropriate.
