FMS Wertmanagement Service GmbH (FMS-SG) was founded in 2012 by FMS Wertmanagement AöR as a dedicated service entity tasked with taking over the portfolio servicing from HRE group in October 2013. FMS-SG has its headquarters in Unterschleißheim, Germany and locations in London, Dublin and New York which are all starting operations in October 2013.
The mother company, FMS Wertmanagement AöR itself, was founded in 2010 as the Federal government's winding-up institution for the nationalised Hypo Real Estate Holding AG (HRE Group). FMS-WM currently receives extensive portfolio servicing from HRE group which by EU-mandate is to terminate at the end of September 2013.
Together with taking over the servicing, according to current planning, TUPE for 43 employees of HRE Group to FMS-SG will take place in London. In addition, further staff will be hired externally, mostly with starting dates at the earliest in October 2013. With regards to benefits, employees of HRE group should receive the same benefits and insurance coverage as before (based on TUPE regulations) while newly recruited staff may receive a different benefit package.
The employees in HRE Group (pbb and Depfa) subject to the TUPE transfer are currently members of a Friends Life Group Personal Pension Plan and will be offered the opportunity of transferring to the new pension plan.The present invitation to tender is organized by The FMS Wertmanagement AöR will procure the tendered services for the London location for the benefit of FMS Wertmanagement Service GmbH. FMS Wertmanagement AöR will act in name and on behalf of FMS Wertmanagement Service GmbH.
For its employees the FMS-Wertmanagement Service GmbH wants to set up a Group Personal Pension Plan (GPPP) and select a provider. A GPPP is an arrangement made for the employees of a particular employer, to participate in personal pension schemes with the same pension provider. Each member has a separate pension policy (contract) with the pension provider, although contributions are collected by the employer who then pays them to the provider.

With the request the tenderer has to name a contact person (name, e-mail address, phone number). 2) The award procedure documents will only be sent if the tenderer have previously submitted the confidentiality agreement to the FMS-Wertmanagement AöR using the contact stated in I.1. 3) The proposal must be submitted by mail and must be manually signed. Written tenders and all related documents must be mandatorily submitted - in a sealed envelope or package. The following terms of the law against unfair competition (GWB) are particularly valid for the lodging of appeals:
§ 107 Introduction, application:
(1) The procurement chamber only initiates an investigation following an application.
(2) Any company may make an application that has an interest in a contract and has had its rights violated in accordance with § 97 (7) GWB by non-compliance with regulatory requirements. Thereby, it must be demonstrated that the company has incurred a loss by the alleged breach of contract award procedure rules or such a loss is threatened.

(3) The application is not allowable to the extent that:
1. The applicant recognized the alleged breach of the contract award procedure requirements in the contract award procedure and failed to immediately report the breach to the contracting entity;
2. Breaches of contract award procedure requirements known on the basis of the announcement may be reported no later than the deadline stated in the announcement for the submission of offers or applications to the contracting entity;
3. Breaches of contract award procedure requirements known on the basis of the contract award procedure documentation may be reported no later than the deadline stated for the submission of offers or applications to the contracting entity;
4. More than 15 calendar days have passed following the receipt of the notification by the contracting entity who does not seek to remedy the complaint. Clause 1 is not valid for an application for determination of invalidity of the contract in accordance with § 101b (1)(2). § 101a (1)(2) shall remain unaffected.

In addition the application for a review by the procurement chamber is admissible if the FMS-SG does not respond to the appeal of the tenderer and there is a danger that the ten days waiting period in accordance with § 101a GWB [Act Against Restraints of Competition] will expire without receiving a decision by the FMS-SG.
