The participant will be provided with log-in data via E-Mail within 3 working days after submittal of the filled in registration template. This is a voluntary contract notice. Nordsee One GmbH has decided to perform a formal procurement procedure solely in order to create a maximum degree of transparency and competition. Nordsee One GmbH is not a contracting entity pursuant to Art. 3, 4 of the Directive 2014/25/EC and to § 98 German Act against Restraints of Competition (GWB). Therefore, Nordsee One GmbH is not bound to the Directive 2014/25/EC, the German Act against Restraints of Competition and/or the German Sector Regulation (Sektorenverordnung). These regulations solely serve as guideline for this procurement procedure. Furthermore, the candidates/ bidders do not enjoy legal protection under the Directive 89/665/EEC and/or the German Act against Restraints of Competition. This negotiated procedure is divided in two parts: First, Nordsee One GmbH will examine formally the requests and check if the nondisclosure agreement as an annex of the request is not lacking, not amended and duly signed. Nordsee One GmbH will evaluate the requests to participate on the basis of the following criteria: commercial, technical and organisational capability, QHSE and Quality Management. After this, Nordsee One GmbH intends to select all qualified candidates in order to invite them to submit their tenders. Secondly, Nordsee One GmbH will evaluate the tenders and negotiate with at least three bidders. The bidders are not entitled to participation in the negotiations. After tender evaluation the contracting entity will represent the results to its insurer. The insurer has a right of veto concerning the evaluation results. In the event that the insurer will refuse the best placed bidder, the contracting entity will close the contract with the second placed bidder if the insurer accepts this bidder etc. Furthermore, the contract award is subject to the approval of the conclusion of the contract by the management of Nordsee One GmbH.

1. The candidate and every member of a bidding consortium has to submit Company Information (informational).

2. Compliance check (knock-out).

3. Confirmation no record of successful court actions involving fraud, corruption or other major breaches of the Companies Act or similar law in an EU Member State (knockout criterion).

4. In case of application as a bidding consortium, the bidding consortium must confirm joint liability for the execution of the total contractual obligations. Furthermore, the bidding consortium has to nominate a lead bidder as representative of the bidding consortium for the tendering procedure (knock-out criterion).
