The public contracting agent wishes to add the following explanations to the contract notice:
1. The award of the contract is subject to the following conditions:
— issue of an amended permit for the operation of the WTG by the Federal Maritime and Hydrographic Agency [Bundesamt fur Seeschifffahrt und Hydrographie — (BSH)]; the procedure to obtain a permit will run in parallel with the procurement procedure,
— consent of the shareholder/partner meeting of the public contracting agent or project company (if one exists at the time of the award of the contract),
— project approval by the banks financing the offshore wind farm.
2. Since the procedure to obtain an amended BSH permit will run in parallel with the procurement procedure, it is possible that specifications and requirements will change during the ongoing procurement procedure. As a result, the public contracting agent reserves the right to make changes to the procurement documents (that are in compliance with the requirements of public procurement law).
3. Trianel GmbH, which has been put in charge of project development, will initially be responsible for this procurement procedure. Trianel GmbH will only to this extent act as the contracting entity. The contractual partner will be the Phase 2 project company, which will hold all of the necessary rights and permits, and be responsible for the construction and operation of the wind farm. The project company may take over the conduct of the procurement procedure.
4. Notwithstanding the ‘no’ answer in II.2.3), it is possible that the service and maintenance agreement will be renewed. Renewal of the contract is planned. It is expected that the question of whether the contract will be renewed and, if so, how often will be the subject of negotiations. It will not be possible to renew the Turbine Supply Agreement.
5. The following declaration forms which are necessary for the pre-qualification procedure have to be requested from the public contracting agent.
Form for the establishment of a group of tenderers containing the information specified in III.1.3).
Declaration about the reliability of the tenderer and about the compliance with certain provisions of the German Criminal Code and similar foreign provisions such as section 21 (1) and (4) of the German Sector Ordinance (Sektorenverordnung — SektVO).
The following forms which are necessary for the declarations required under III.2.3) have to be requested from the public contracting agent:
— declaration regarding the number WTGs installed offshore together with details of the installed capacity per generator and the calendar year in which each generator was commissioned,
— declaration regarding WTGs installed offshore or onshore of the type considered for the tender (including onshore prototypes) — if necessary, broken down by the considered types and the calendar year of commissioning in each case,
— declaration regarding experience in maintenance, repair and overhaul of WTGs (within the meaning of DIN 31051) as the responsible contractor broken down by calendar years and years of turbine operation (broken down by years and turbines as well as whether onshore or offshore),
— number of offshore WTG installations carried out by the tenderer/member of the group of tenderers acting as responsible contractor (including logistics services) for offshore WTGs (including details of the year of installation),
— declaration as to the fabrication capacity for producing the considered WTGs per calendar year (currently, 2016, 2017 and 2018),
— declaration that the WTG(s) under consideration have a rated power of at least 6 MW, maximum rotor diameter of 164 m and stating the interface flange level necessary to limit the maximum rotor blade height of 200 m above LAT.
— declaration that the manufacturer has complied with/continues to comply with the IEC 61400-1 Standard (most recently published version) and — to the extent applicable in connection with type certification of wind turbines — with the requirements of the IEC 61400-3 Standard (most recently published version).
— declaration from the company that the WTG would not prevent compliance with the TenneT-Grid Code in the version in force on 31 July 2015.
— declaration as to the suitability of the turbine under the wind conditions prevailing at the wind farm as shown in the attachment to the Project Summary (to be obtained from the public contracting agent).
The tenderer is obliged to provide the following documents itself or, as the case may be, to submit a personal undertaking (without using a form provided by the public contracting agent) is as follows:
— Excerpt from the trade register or a register which is similar if applicable;
— Company presentation including ownership structure, scope of services, manning level;
— Annual financial statements, financial reports, balance sheet (in the case of German tenderers) comparable documents (in the case of foreign suppliers). If the turnover from offshore wind energy is not evident from the documents, then explanatory notes should be added.
The forms available from the public contracting agent should be requested from it. In addition, a Project Summary, which contains detailed information about the project, can be requested from the public contracting agent.
Questions about the pre-qualification procedure may be sent by e-mail or fax to the contact points mentioned in I.1). The public contracting agent will make all of the questions and answers from participants available in anonymized form.
6. Questions about the EU contract notice and the related documents may be submitted by no later than 11 September 2015 to the contact point mentioned in I.1. The public contracting agent is not obliged to answer questions submitted after this date.

The establishment of a group of tenderers/consortium is permissible. However, a member of a group of tenderers is prohibited from submitting its own tender or belonging to another group of tenderers at the same time. If a group of tenderers is established, it will be obliged to submit a legally binding declaration signed by all of its members together with the request to participate (the form is contained in the tender documents). The form must contain:
