The objective of the assignment is to support the government of Vietnam in the development of an economically and technically feasible net metering scheme focusing on solar rooftop installations within the framework of the pending feed-in tariff regulation. The aforementioned FiT regulation, under which the net metering policy would fall, contributes to the solar energy targets under the National Master Plan for Power Development and forms part of the government's strategy to foster the country's energy sector transformation to a low-carbon sustainable energy system through renewable energy diffusion.

Kurze Beschreibung:

The assignment described in this document should support the Electricity Regulatory Authority of Vietnam (ERAV) in achieving the objectives stated in the following points.

1. Description of expected outcomes.

The main expected outcome is:

— ERAV has the capacity to develop an economically and technically feasible net metering policy for the promotion of solar rooftops in Vietnam within the framework of the pending feed-in tariff regulation.

2. Description of expected outputs.

The main expected outputs are:

— Package of all necessary net metering documentation for solar rooftop installations and countrywide application has been designed and submitted to ERAV. Such material would include:

a. A draft regulatory decision with appropriate design features for a net metering policy and options have been discussed in an accompanied by a recommendation paper.

b. The necessary technical requirements for integration into the distribution grid.

c. Licensing templates:

— The net metering documents have been validated in a specific limited grid area.

— The overall economic and technical solar rooftop potential in Vietnam has been estimated.

— Key personnel from ERAV, the General Directorate of Energy (GDE) of the Ministry of Industry and Trade (MoIT) and Vietnam Electricity (EVN) have been instructed and are familiar with the net metering documentation and its application.

3. Scope of work:

The consultant(s) should structure their work in the five phases described in the tender documents:

Phase 1: Inception.

Phase 2: First draft of the net metering documents.

Phase 3: Impact assessment and document adaptation.

Phase 4: Implications of a country wide implementation.

Phase 5: Capacity building activities and final documents.

Beschreibung der Optionen:

Within the framework of the basic project described in the terms of reference, GIZ reserves the right to award contracts for additional services of this type of approximately the same amount to the successful company in this procedure by means of a negotiated procedure without a prior call for competition.

The price adjustment pursuant to section 5.25 of the General Terms and Conditions of Contract shall be determined by the mean collectively agreed salary increases under GIZ's collective bargaining agreement during the term of this contract.

(2) Declaration on the personal situation of the applicant or the member of the consortium, consisting of:

(a) Declaration on the absence of the mandatory grounds of exclusion as per section 123 Act against Restraints of Competition (Competition Act — GWB) or on the remedial actions and the measures.

(b) Declaration on the absence of the optional grounds of exclusion as per section 124 GWB or on the remedial actions and the measures.

Wirtschaftliche und finanzielle Leistungsfähigkeit:

(1) Declaration on the average annual turnover for the last 3 financial years (last-but-four financial year can be included in case of invitation to tender held within 6 months of end of last financial year),

(2) Declaration on the employees of the applicant or the member of the consortium as at 31.12.2015.

Mindeststandards:

For (1): at least 300 000 EUR (net) for the applicant or the consortium.

For (2): at least 5 employees for the applicant or the consortium.

Technische und berufliche Fähigkeiten:

Declaration on reference projects of the applicant or the member of the consortium in the technical field of ‘power sector and technical grid operation and analysis of renewable energy policies and regulation’. There are particular to provide the informations to the project title, the client, the period, the contract value in EUR and the Country.

Mindeststandards:

At least 3 projects in the technical field of…

All reference projects must have been provided within the last 5 years with a minimum commission value of at least 150 000 EUR (net).

According to section 160, paragraph 3 sentence 1 Act against Restraint of Competition (Competition Act —GWB), application for the review proceeding is inadmissible if:

1. the applicant has identified the claimed infringement of the contract award regulations before submitting the application for the review proceeding and has not submitted a complaint to the contracting entity within a period of 10 calendar days; the expiry of the period pursuant to section 134, paragraph 2 GWB remains unaffected;

2. complaints of infringements of contract award regulations that are evident in the notice are not submitted to the contracting entity at the latest by the expiry of the deadline for the application specified in the notice or by the deadline for the submission of bids;

3. complaints of infringements of contract award regulations that 1st become evident in the tender documents are not submitted to the contracting entity at the latest by the expiry of the deadline for application or for the submission of bids;

4. more than 15 calendar days have expired since receipt of the notification from the contracting entity that it is unwilling to redress the complaint.

Section 160 paragraph 3 Sentence 1 GWB does not apply in the case of an application to determine the invalidity of the contract in accordance with section 135 paragraph 1 number 2 GWB. Section 134, paragraph1,sentence 2 GWB remains unaffected.
