1. This procurement procedure in its entirety is carried out jointly in the name and on behalf of DFS and LVNL. DFS is responsible for managing the procurement procedure for both parties and is the single point of contact for the tenderer. After contract award DFS ans LVNL will sign separate contracts under separate jurisdictions with the chosen tenderer. 2. The correspondence during the procurement procedure and during contract execution shall be exclusively in English. Tenders have to be submitted in English language. The contract between DFS and the contractor will be concluded in the German language. The contract between LVNL and the contractor will be concluded in the English language. 3. An application is only possible using the required documents provided by the contracting authority. Formless applications will not be considered. The documents must be submitted together in duplicate, on time and locked. 4. Consortia must already apply as consortia. The subsequent formation of a consortium is not possible. Consortia have to provide the required information for every member. They have to designate a lead partner and to authorize him to represent the consortium and receive payments for all members in discharge of the liability for the contracting authority. A formal agreement to this effect must be signed by each member of the consortium and attached to the request to participate. 5. With regard to criteria stated under Sections II.1.2 and III.1.3 the tenderer may rely on the capacities of other entities. Where a tenderer wants to rely on the capacities of other entities, he shall prove to the contracting authority that he will have at its disposal the resources necessary by providing a written commitment of those entities to that effect. 6. The contracting authority may ask tenderers at any moment during the procurement procedure to provide further information with regard to the conditions of participation or to submit supporting documents. The contracting authority may also require the tenderer to prove the economic and financial standing and the technical and professional ability of subcontractors and their suitability to pursue the professional activity. 7. Kurze Beschreibung:

Scope of delivery and services are 18 Doppler VHF (Very-High-Frequency) Omnidirectional Range (DVOR).

The DVOR is a radio navigation aid recommended by the ICAO and introduced internationally for short and medium range aircraft guidance.

The DVORs to be delivered have to comply with the International Standards and Recommended Practices to the Convention on International Civil Aviation Organization (ICAO) Annex 10, Aeronautical Telecommunications, Volume 1 Radio Navigation Aids, Section 3.3 Specification for VHF omnidirectional radio range (VOR).

Scope of delivery:

DFS: Fourteen DVOR

LVNL: Four DVOR

Delivery period: 2017 until 2020.

Dauer: 38 Monate

Bedingungen für die Teilnahme
Befähigung zur Berufsausübung:

1. Certificate of registration in a Professional or Commercial Register not older older than six months. If the applicant is not obliged to register in a Professional or Commercial Register according to the statutory provisions in his home country an equivalent proof of the existence and the seat of the company (not older than 6 months) shall be provided.

2. Declaration of Innocence: Self-declaration on the absence of the mandatory or optional grounds of exclusion as per section 123 an 124 Act against Restraints of Competition (Competition Act — GWB) or on the remedial actions and the measures.

3. Written declaration of the tenderer, if and for which significant part of deliverables and/or services subcontraction is intended. The ‘Declaration of Innocence’ has to be provided for each subcontractor too.

Wirtschaftliche und finanzielle Leistungsfähigkeit:

1. Company presentation in terms of organization and ownership structure of the company.

2. Product liability insurance police for personal injuries,

property and pecuniary damages of at least EURO

1.000.000 or a corresponding preliminary promissory

note of an insurance company.

3. Declaration on the average total turnover and VOR/DVOR turnover for the years 2013-2015.

4. Declaration on the total number of employees and number of employees working in the VOR/DVOR department for the years 2013-2015.

Companies who are in business for a shorter period than three years (Newcomer) provide only the information in relation to the duration of their business.

Mindeststandards: The average total turnover per year has to be at least 4 000 000 EUR
Technische und berufliche Fähigkeiten:

1. Profiles of key employees especially the quality manager, the project manager and the head of technical department responsible for DVOR.

2. Description of the technical equipment, the measures and procedures for ensuring quality and the study and research facilities.

3. References for the delivery and installation

of DVOR systems within the last three years stating

the reference customer with a short description of the

delivered system, point of contact and execution time.

Mindeststandards:

1. Three commissioning engineers for DVOR systems

2. One commissioning engineer for DVOR systems

with at least five references within the last three years

of successful commissionings of DVOR.

3. Five References for the delivery and installation

of DVOR systems within the last three years according to No. 3.

4. ISO certification ( ISO 9000 ) or comparable.

According to section 160, paragraph 3 sentence 1 Act against Restraint of Competition (Competition Act — GWB), application for the review proceeding is inadmissible if

1. the applicant has identified the claimed infringement of the contract award regulations before submitting the application for the review proceeding and has not submitted a complaint to the contracting entity within a period of 10 calendar days; the expiry of the period pursuant to section 134, paragraph 2 GWB remains unaffected,

2. complaints of infringements of contract award regulations that are evident in the notice are not submitted to the contracting entity at the latest by the expiry of the deadline for the application specified in the notice or by the deadline for the submission of bids,

3. complaints of infringements of contract award regulations that 1st become evident in the tender documents are not submitted to the contracting entity at the latest by the expiry of the deadline for application or for the submission of bids,

4. more than 15 calendar days have expired since receipt of the notification from the contracting entity that it is unwilling to redress the complaint.

Section 160 paragraph 3 Sentence 1 GWB does not apply in the case of an application to determine the invalidity of the contract in accordance with section 135 paragraph 1 number 2 GWB. Section 134, paragraph 1, sentence 2 GWB remains unaffected.
