The public contracting entity wishes to add the following explanations to the contract notice:

1. The award of the contract is subject to the following conditions:

— Issue of an amended permit for the operation of the Offshore Windfarm by the Federal Maritime and Hydrographic Agency (Bundesamt fur Seeschifffahrt und Hydrographie — (BSH)); the procedure to obtain a permit will run in parallel with the procurement procedure.

— Consent of the shareholder/partner meeting of the public contracting entity.

— Project approval by the banks financing the offshore wind farm.

2. The procedure to obtain an amended BSH permit will run in parallel with the procurement procedure. The public contracting entity reserves the right to amend the specifications and requirements during the ongoing procurement procedure to reflect any requirements by the BSH. As a result, the public contracting entity reserves the right to make changes to the procurement documents (that are in compliance with the requirements of public procurement law).

3. The following declaration forms which are necessary for the pre-qualification procedure have to be downloaded from the Deutsche Vergabeportal.

— Form (L) for the request to participate,

— Form (A) for the establishment of a group of tenderers containing the information specified in III.1.3),

— Form (B) for the declaration about the reliability of the tenderer and about the compliance with certain provisions of the German Criminal Code and similar foreign provisions such as section 21 (1) and (4) of the German Sector Ordinance (Sektorenverordnung — SektVO),

— Form for the Declaration (C) that the tenderer will work and has worked following a certified quality management system according to DIN EN ISO 9001,

— Form for the declaration (L) that the tenderer is ready to provide in German language all documentation to be filed to the German authorities,

— Form for the declaration (D) stating the resources that can be ensured for the project,

— Form for the declaration (E) on the expected fabrication capacity of the bidder for each of the years from 2017 to 2018 for producing Monopiles and Transition Pieces,

— Template for the project reference table (F) for the Monopiles and Transition Pieces that have been manufactured,

— Template for the project reference table (G) for completed onshore and offshore logistics and installation engineering projects concerning MP/TP offshore foundations,

— Template for the project reference table (H) for scour protection projects,

— Form for the declaration (I) concerning the technical capacity and capabilities for the outfitting.

The tenderer is obliged to provide the following documents itself or, as the case may be, to submit a personal undertaking (without using a form provided by the public contracting entity) as follows:

— Excerpt from the trade register or a register which is similar if applicable.

— Company presentation including ownership structure, scope of services and manning level.

— Annual financial statements, financial reports, balance sheet (in the case of German tenderers) comparable documents (in the case of foreign suppliers) for the last 3 financial years.

— Description of the established HSE management system structure and organisation.

— Certificate declaring the occupational and health assessment series in accordance with OHSAS 18001 or similar standards in force at time of the official announcement of the tender.

The forms available from the public contracting entity should be downloaded from the Deutsche Vergabeportal. In addition, a Project Summary, which contains detailed information about the project, can also be downloaded from the Deutsche Vergabeportal.

Questions about the pre-qualification procedure may be submitted through the Deutsche Vergabeportal. The public contracting entity will make all of the questions and answers from participants available in anonymized form.

4. Questions about the EU contract notice and the related documents shall be submitted through the Deutsche Vergabeportal by no later than 12.2.2016 to the contact point mentioned in I.1) The public contracting entity is not obliged to answer questions submitted after this date.

5. Requests to participate must be submitted by Post to the address mentioned in Annex A III and contain also the digital version of the request to participate including all documentation on a USB-stick.

6. Companies interested in the tender competition must apply for participation in the negotiation procedure. The documents for requesting to participate are made available exclusively in electronic form on the Deutsche Vergabeportal at https://www.dtvp.de/ after a prior one-time, free registration. The continuing tender procedure and the subsequent proceedings will also be conducted in German.

Replies to application questions, as well as overall communication between applicants and the tendering entity will take place exclusively on the above-named tendering portal. Within the exclusive economic area according to the United Nations Convention on the Law of the Sea of the North Sea. The Trianel Windpark Borkum (Phase II) is situated 45 km north of the island of Borkum at a water depth of approximately 28 to 33 meters at lowest astronomical tide. Main site or location for the onshore-production are the facilities of the contractor.
