The planned offshore converter station BorWin gamma is part of the transmission link BorWin3. The water depth at the platform location is ~ 40m relative to Lowest Astronomical Tide (LAT).The entire scope of the clearance services encompasses:— Geophysical survey to identify potential UXO objects within the prescribed area that will cover the footprint of the platform, the working area around and anchor areas for the installation spread. Contractor will host a ‘route working group meeting’, which aims at the set-up of the identification and disposal program on-site of potential UXO objects that cannot be avoided. A clearance certificate for areas free of objects has to be issued;— Positive identification of the potential UXO objects resulting from the ‘route working group meeting’ at the platform site;— Where required, disposal to shore of any actual UXO objects if safe to transport or detonation on-site if unsafe to do so. Where required, disposal to shore of any actual non-UXO objects that might hinder any installation works. Issuance of final target clearance certificate (s) for all objects inspected and removed.All work stages have to accompanied by at least 1 qualified EOD supervisor certified according section 20 German Explosive Law (SprengG) per working shift.Geophysical Survey:The geophysical survey will commence with full systems tests and calibrations in port and offshore, and a surrogate item trial on-site in order to prove the survey spread. Only when these are completed and approved shall the geophysical route survey be conducted within the specified area, acquiring multi-beam bathymetry, side-scan sonar, sub-bottom profiler and magnetic gradiometer data.During the survey, all data shall be processed on-site and delivered to the Contracting Entity within 24 hours of completion of acquisition so that decisions regarding data quality, gaps, re-work and development can be made on-site as soon as possible after acquisition. If this cannot be achieved offshore then an onshore data processing facility shall be set up to facilitate data transfer to shore and access to the Contracting Entity.Upon completion of the geophysical survey and prior to the submission of the draft final report, Contractor will host a ‘route working group meeting’ at its premises in order to review the geophysical data and agree with Contracting Entity and its UXO Consultant on the identification and disposal program. The outcome of this meeting shall be a field layout for installation that avoids as many potential UXO objects as possible, a final potential UXO object list for subsequent detailed identification the clearance certificate.The following submissions will be required as a minimum:— Mobilisation report of all tests, calibrations and the surrogate item trial (SIT). Mobilisation shall be complete when all activities are approved by the Contracting Entity;— Daily progress reports to be issued each morning for the previous day's work of an agreed format and content;— Preliminary processed bathymetric, sea-floor imagery, geological profiles and magnetic data within 24 hours of acquisition;— A field operations report shall be issued on completion of completion of the survey at sea, containing as a minimum the preliminary processed survey results and conclusions;— A complete draft final report including the method statements, results, conclusions and data (raw and processed) shall be delivered in German and English within the specified time after completion the survey at sea;— Final submissions in German and English shall be within the specified time after receipt of final comments from the Contracting Entity on the draft final submission.Identification and disposal operations:The phase will only commence with full systems tests and calibrations in port and offshore, and a surrogate item trial on-site in order to prove the working spread. Only when these are completed and approved shall the identification works commence. All objects given in the final potential UXO object list that cannot be avoided shall be inspected preferably by an ROV in order to determine if the object is actual UXO or not. This may require de-burying of the object. Non- UXO items may need to be recovered if they hinder the upcoming installation works. The Contractor will issue a clearance certificate for all objects inspected and identified stating the precise nature of the object if any is found.The following submissions will be required as a minimum:— Mobilisation report of all tests, calibrations and the surrogate item trial (SIT). Mobilisation shall be complete when all activities are approved by the Contracting Entity;— Daily progress reports to be issued each morning for the previous day's work of an agreed format and content;— Target search reports and original clearance certificates within 24 hours of inspection and identification;— A field operations report shall be issued on completion of completion of the survey at sea, containing as a minimum the inspection results, clearance certificates and conclusions;— A complete draft final report including all method statements, results, signed clearance certificates, conclusions and data (raw and processed) shall be delivered in German and English within the specified time after completion the survey at sea;— Final submissions in German and English shall be within the specified time after receipt of final comments from the Contracting Entity on the draft final submission.Disposal Operations (if conducted from a different vessel than the identification works) and Detonation:If conducted from a separate vessel spread to the visual identification works then this phase will only commence with full systems tests and calibrations in-port and offshore, and a surrogate item trial on-site in order to prove the working spread. Only when these are completed and approved shall the disposal works commence. Once a potential UXO target is positively identified as hazardous UXO that cannot be avoided, the Contractor's EOD Manager, who is certified according section 20 German Explosive Law, shall decide whether or not the UXO item can be safely recovered and transported to shore or if has to be detonated on-site. All applicable rules, guidelines, mitigation measures and ordinances will be followed, and appropriate communications with the relevant authorities (BSH, etc.) will be made. Final detonation will only take place when all regulatory permissions and clearances from the authorities and TenneT marine coordination centre are in place. The Contractor will issue clearance certificate for all actual objects cleared.The following submissions will be required as a minimum:— Daily progress reports to be issued each morning for the previous day's work of an agreed format and content;— Target search reports and original signed clearance certificates within 24 hours of disposal.If conducted from a separate vessel spread to the visual identification works, then the following reports will also be required:— Mobilisation report of all tests, calibrations and the surrogate item trial (SIT). Tenderer must hand in 1 hard-copy and 1 digitalized copy in a standard format like .PDF on a USB drive or CD. Participation requests transmitted via e-mail are not acceptable and may lead to an exclusion of the concerning attendee.
DC Netz BorWin3 GmbH reserves the right to suspend or terminate the whole tender procedure or a part thereof. Tenderers will not be entitled to any compensation in that event.
DC Netz BorWin3 and all of its affiliates according to the AG §§ 15ff Akt, reserve the right of extension to use this contract.
The time-limit in accordance with § 107 Abs. 3 Nr. 4 GWB is relevant.
DC Netz BorWin3 GmbH receives the right to short-list the number of tenderers during the tendering/negotiation phase, based on the award criteria.
Concerning II.3) Duration of the contract:
This duration is to be confirmed but the following options are considered which may require multi-vessel survey, inspection and disposal spread operations.

In order to qualify the following is requested:
— Current certificate according section 7 German Explosive Law and current certificates of at least 2 EOD managers certified according section 20 German Explosive Law;
— Current certificate of registration from the Chamber of Commerce. The date stamp on the certificate should not be older than 3 months;
— Corporate Organizational Chart, as well as the Organizational Chart of the entity that would carry out the works;
— Organizational evidence that the number of employees is larger than 30 including the potential employees that could be assigned to this tender;
— Existing Protection and Indemnity liability insurance with coverage of 50 000 000 USD by confirmation / certificate of insurance;
— Existing Marine Liability insurance for UXO-activities / liability insurance including Offshore with coverage of 20 000 000 EUR by confirmation / certificate of insurance;
— Statement that no insolvency proceedings take place.
— The annual reports of the last 3 fiscal years;
— Proof that the revenue resulting from UXO-works per annum is above 1 000 000 EUR during the last 3 years.
In order to qualify the following is requested:
1. Contractor shall demonstrate/prove at least 5 years of experience with comparable projects, which required similar geophysical competency as needed for this project. (At least proof of 2 projects shall be submitted).
The following information should be included in a short reference summary:
— Name of the client (including contact person in case of queries);
— Place of execution of the project;
— Total cost of the (survey) project;
— Duration of the contract;
— Year of execution of the contract,
— Description of the main tasks that have been performed by your entity.
2. The Contractor has to ensure that the proposed staff has the ability to work in a multilingual and multicultural environment. The allocated staff shall have a good or better command of written and spoken English (at least at European language level C1 written and spoken). English will be the predominant language of the project.

3. Statement of the company's ability to plan and manage the works and if applicable for design and detailed engineering for the specified restrictions as mentioned above (i.e. Contractor must be able to meet the restrictions of delivering reports and data within the above mentioned time-frame).

4. Details of any proposed subcontractors including management and quality assurance plans.
5. Data sheets of the proposed vessels, tools and technical equipment for carrying out the scope of work. The minimum requirements for the vessel and equipment are as follows:
— Redundant and state of the art positioning system, redundant and state of the art motion reference system, MBES, SBP (e.g. Innomar SES2000 or similar), towed Gradiometer array able to measure the total field and the vertical gradient and towed Side Scan Sonar;

— Simultaneous operation of all geophysical sensors;
— Remotely operated vehicle and diver Systems;
— Airlift systems;
— Class 2 vessel capable of performing the work with the requested data quality with 24 hour operation for 30 days in the required water depth;
— On board data processing of geophysical data with geopersonnel available;
— The vessel shall have single cabins and office facilities for up to 2 Company representatives.
6. Statement of the contractor's (including major subcontractor's) SHE management system, organization and personnel resources with principles for implementation for this project. Further, the company shall state its records of incidents/accidents (including Lost Time Incidents LTI, Lost Time Incident Frequency LTIF) for the last 5 years.

8. Statement of the company's quality management system according to ISO 9001 or similar. The same applies for major sub-contractors.
9. Any tenderer working with high explosives needs to be qualified according to German federal law Section 7 Sprengstoffgesetz (or HE law), originating from the ‘Gewerbeaufsichtsamt’ (German trade control/ supervisory) for survey, identification and disposal works.

In addition, the entire work can only be overseen by a ‘competent person’ as defined in Section 20 of the German Explosive Law (SprengG), and the UXO contractor would need to have as minimum 1 person on board per shift (i.e. EOD Manager) to manage this process. A proof is needed.
