Consultancy contract: Environmental improvement in industries (under Sustainable and Environment-friendly Industrial Production project)

The Sustainable and Environment-friendly Industrial Production (SEIP) project is a joint project of GIZ and the Indian Ministry of Environment, Forest and Climate Change (MoEFCC) within the framework of the Indo-German Development Cooperation and has a focus on industrial environmental management. The project's objective is, ‘Private and public stakeholders will be supported in jointly implementing strategies for efficient, environment-friendly, and climate-friendly industrial development.’ The project aims to work on significant environmental problems of national importance related to waste water and waste management for which technical solutions and business/management models can be showcased with positive results and direct impact on improving the environmental conditions at the selected sites. Further on, the successful cases are expected to serve as models that can be taken up on much larger scale subsequently. The project operates at three project sites, viz. Delhi, Vapi (Gujarat), Haridwar (Uttarakhand).

The key project indicators are:

i. Decrease in pollution in the surroundings of the three industrial sites by an average of 20 percent measured by 5 selected parameters;

ii. Development programmes and/or promotional guidelines for the three industrial areas that aim at increasing resource efficiency and preventing/reducing pollution;

iii. Incorporation of measures in central government policies, plans and/or programmes to prevent and reduce pollution and to improve resource efficiency in industrial zones;

iv. Replication in ten industrial zones; and additional practical examples regarding management and planning methods of sustainable industrial zones supporting women are made available for the private and state actors involved.

The project is implemented by a central project management team at GIZ Office in Delhi, as well as project teams at each of the project sites in Vapi, Delhi and Haridwar.

One pillar of the SEIP project is focusing on environmental improvements in individual industries. Here, the project aims to demonstrate environmental improvements in selected industries through implementation of technically sound and financially viable techniques/technologies for process optimisation, resource efficiency (materials, water, energy) etc. These improvements should result in the reduction of environmental pollution (water, air and soil) by 20 %, measured by selected parameters with respect to baselines, to be established at the start of the project. Furthermore, the replication of the successful experiences in other industries/industrial areas should be enabled.

The consultancy services envisaged are expected to support the reduction of consumption of raw materials, water and energy besides supporting the reduction of pollution levels at individual industry level. The measures to be implemented may be related to process improvements, recycle/reuse/close-loop measures, cleaner production etc. For providing solutions to individual industries, standard tools such as Profitable Environmental Management (PREMA) and Ecoprofit, and/or RECP (Resource Efficient and Cleaner Production) techniques, and/or solutions from the European BAT (Best Available Techniques) or BREF (Best Available Techniques Reference Documents) and/or a mix of these or other similar instruments etc. may be used or customized consultancy services may be provided.

According to Article 160, Section 3 of the German Act Against Restraint of Competition, application for

reexamination is not permissible insofar as:

1. The applicant has identified the claimed infringement of the contract award regulations before submitting the

application for re-examination and has not submitted a complaint to the commissioning party within a period of

10 calendar days; the expiry of the period pursuant to Article 134, Section 2 remains unaffected;

2. Complaints of infringements of contract award regulations that are evident in the notice are not submitted to

the commissioning party at the latest by the expiry of the deadline for the application specified in the notice or by

the deadline for the submission of bids;

3. Complaints of infringements of contract award regulations that 1st become evident in the tender documents

are not submitted to the commissioning party at the latest by the expiry of the deadline for application or for the

submission of bids;

4. More than 15 calendar days have elapsed after receipt of the notification from the commissioning party that it

is unwilling to redress the complaint.

Sentence 1 does not apply in the case of an application to determine the invalidity of the contract in accordance

with Article 135, Section 1 (2). Article 134, Section 1, Sentence 2 remains unaffected.
