KfW

KfW intends to conclude a framework agreement with 3 economic operators to review and appraise KfW project documentation for compliance with the environmental and social standards set out in KfW's Sustainability Guidelines, current World Bank standards, and Equator Principles.
In addition to review and appraisal services, which comprise approx. 90 % of its requirement, KfW requires training of KfW project personnel (employees and external staff) as well as complex analysis and risk assessment of project environmental and social impacts. These services comprise approx. 10 percent of the requirement.
The duration of the individual assignments for review and appraisal is approx. 3 to 10 days each. The duration of single assignments for training and complex analysis and risk assessment will vary.
The assignments for review and appraisal will be awarded to the 3 contractors by means of a Cascade mechanism, the tasks for training and complex analysis by means of mini-competitions.

The sectoral and geographic variables of the individual assignments for review and appraisal services as well as for training of KfW's project personnel (employees and external staff), complex analysis and risk assessment of environmental and social impacts will vary considerably. KfW does not foresee any specific fields of specialisation. However, generally the requirements regarding both aforementioned kinds of single assignments are expected to arise in the following sectors:

1. Infrastructure (e.g. roads, transmission line, railway, pipelines);

2. Waste management (e.g. waste treatment plant, landfills, sewage networks);

3. Agribusiness;

4. Conservation / Nature Protection;

5. Mining;

6. Industrial facilities (e.g. cement-, steel-, petrochemical plants);

7. Municipal facilities (e.g. water supply and sanitation, health care facilities);

8. Oil and gas;

9. Energy (e.g. renewables, geothermal and thermal power);

10. Water resources (e.g. dams, desalination plants, water management);

11. Financial Intermediaries.

Particularly complex single assignments will require specialised home-office support. To ensure the high quality of deliverables needed and effective coordination with the contractor's home office, KfW requires dedicated project management and quality assurance capabilities within the contractor's team.

Regardless of whether the individual assignments concern review and appraisal services or training, complex analysis and risk assessment of environmental and social impacts, they will as a rule all be carried out through desk review and occasional field missions to KfW project sites or visits to project partners.

Hauptstandort oder Erfüllungsort:

While the contract is governed by German law and the place of arbitration shall be Frankfurt upon Main (Germany), the contractors will occasionally need to visit the project sites abroad.

Bedingungen für die Vertragserfüllung:

(1) As the execution of the services will involve that the contractor processes, saves, prints, stores, and/or transfers personal data of KfW, it is necessary that he observes the additional contract terms and conditions for data processing and Information management. Therefore, the tenderer must:

(a) have an in-house data protection manager, if he is legally obliged to, and

(b) fulfil the operating requirements stipulated in the terms of reference regarding the security of the contractor's data connection and physical data processing during contract performance, and

(c) deliver an appropriate privacy and data security concept, demonstrating how he will specifically implement the technical and organisational measures and preparations for the protection of privacy and data security, and

(d) evidence that he has established an effective information security management system.

(2) Compliance with International Labour Standards is compulsory.

(1) The candidate's Team Manager has a high level of general professional experience in performing services of the tendered kind:

(a) More than 8 years of experience in responsibly directing and managing international projects immediately related to environmental and social assessment or Management. Every 2 years of additional experience up to 17 years or more shall be rewarded.

(b) More than 5 years of project management experience in an environment characterized by a workflow consisting of multiple short-term assignments funded by development banks or Equator Principles Financial Institutions. Every 2 years of additional experience up to 14 years or more shall be rewarded.

(c) More than 5 years of experience in managing and supervising quality control measures with regard to environmental and social assessments funded by development banks or Equator Principles Financial Institutions. Every 2 years of additional experience up to 14 years or more shall be rewarded.

(2) The Team Manager has project references demonstrating that he is not only able to cover the following types of tasks once, but twice or three times:

a. Environmental and social appraisal,

b. Preparation of Environmental and Social Action Plan,

c. Preparation of an Environmental and Social Impact Assessment,

d. Preparation of an Environmental and Social Management Plan,

e. Gap analysis of an Environmental and Social Impact Assessment and an Environmental and Social Management Plan.

(3) One or both of the candidate's Environmental Experts has a high level of general professional experience in performing services of the tendered kind:

(a) More than 10 years of experience in an advisory role in environmental and resource protection, developing and implementing environmental management plans, protecting neighbouring communities or areas with biodiversity values. Every 2 years of additional experience up to 19 years or more shall be rewarded.

(b) More than 5 years of experience in conducting environmental impact assessments for projects funded by development banks or Equator Principles Financial Institutions. Every 2 years of additional experience up to 14 years or more shall be rewarded.

(c) More than 5 years of experience in implementing and monitoring environmental management plans for projects funded by development banks or Equator Principles Financial Institutions. Every 2 years of additional experience up to 14 years or more shall be rewarded.

(4) One or both Environmental Experts has project references demonstrating that he is not only able to cover the following types of tasks once, but twice or three times:

Tasks as shown for the Team Manager above (2) a.-e., but focussing on environmental and resource protection aspects.

(5) One or both of the candidate's Social Experts has a high level of general professional experience in performing services of the tendered kind:

(a) More than 10 years of experience in an advisory role with project affected communities, development and implementation of resettlement plans and livelihoods restauration plans, stakeholder and community Engagement. Every 2 years of additional experience up to 19 years or more shall be rewarded.

(b) More than 5 years of experience in conducting social impact assessments and human rights assessments in projects funded by development banks or Equator Principles Financial Institutions. Every 2 years of additional experience up to 14 years or more shall be rewarded.

(c) More than 5 years of experience in implementing and monitoring social management plans for projects funded by development banks or Equator Principles Financial Institutions. Every 2 years of additional experience up to 14 years or more shall be rewarded.

(6) One or both Social Experts has project references demonstrating that he is not only able to cover the following types of tasks once, but twice or three times:
