FMS Wertmanagement was founded in 2010 as the Federal government's winding-up institution with the aim of taking over risk positions and non-strategic operations from the HRE Group and unwinding them. Effective 1 October 2010, FMS Wertmanagement took over from both the HRE Group risk positions and non-strategic operations. FMS Wertmanagement Service GmbH, a wholly-owned subsidiary of FMS-WM, operates as a service provider for FMS-WM for its portfolio and the associated refinancing resources. The services provided for FMS-WM comprise credit analysis and review, asset restructuring, workout management, detailed portfolio reporting, payment collection and arrears monitoring. FMS-SG assumed management of the portfolio of FMS-WM since 1.10.2013.The present invitation to tender is organized by FMS-WM on behalf of FMS-SG.

The contracting authority plans to develop internal PD rating models for Large Corporates (in the following: issuers) with a special focus on Regulated Utilities using a so called ‘shadow rating approach’, which amongst others, shall be based on financial information.

Therefore the contracting authority is looking for a database containing quantitative financial statements information (P&L, balance sheets, cash flow statements) on an individual basis (corporates and/ or corporate group level). Additionally, the data base must include ratings from an External Credit Assessment Institution (ECAI) Rating Agency recognized by the European Central Bank (ECB) as well as a Nationally Recognized Statistical Rating Organization (NRSRO) in the USA.

An easy and unique issuer based matching of external ratings and financial statements must be ensured.

The contracting authority refers, in particular, to section 160 paragraph 3 Nr. 1 GWB (Act Against Restraints of Competition). Under this act, an application for review is only admissible if that application is made within 10 calendar days after becoming aware of the violation of public procurement provisions during the award procedure.

Breaches that become apparent from the tender notice or the procurement documents must, at the latest, be notified to the contracting authority by the end of the period for the submission of a tender or application specified in the notice (section 160 paragraph 3 No 2 and No 3 GWB).

If the contracting authority gives notice that it is unwilling to redress the complaint, the application for a review proceeding may be submitted in writing to the public procurement tribunal only within 15 calendar days of receipt of such notice (section 160 paragraph 3 No 4 GWB); in this context the date of receipt of the application for a review proceeding by the public procurement tribunal will be decisive in determining whether the time limit has been observed.
