The services provided by the consultant will address NBA's legal framework (Water Charter), NBA's technical planning and monitoring capacities (technical planning, monitoring and evaluation) as well as its financial programming capacities (financial programming):
Water Charter:
The Water Charter is a binding interstate convention governed by international law, which defines the principles of institutional and legal cooperation around the waters of the Niger River Basin. It provides for the preparation of five implementation annexes defining environmental protection obligations (1), operational and coordinated management of dams (2), notification procedures for planned measures (3), cost-benefit sharing (4) and the legal status of common infrastructure or infrastructure of common interest (5). The Charter was adopted by the 8th Summit of Heads of State and Government held on 30.4.2008 in Niamey-Niger. Since its entry into force on 19.7.2010, 3 annexes (1, 3 and 4) out of the 5 planned have been adopted.
The Water Charter defines the Common Infrastructure and Infrastructure of Common Interest as respectively ‘a work for which the Member States of the Niger Basin Authority have decided by a legal act that it is their common and indivisible property’ and ‘a work having an interest for 2 or more Member States of the Niger Basin Authority and for which they have by common agreement decided on coordinated management’.
The consultant's task will be the participatory (together with the representatives of Member Countries) elaboration of a draft for Annex 5 (legal status) in line with the orientations set by Annex 4 (economic model of cost-benefit sharing).
Technical planning, monitoring and evaluation:
The NBA Operational Plan is now the main tool for technical programming of the NBA in the sense of joint planning for the management and development of the basin's water resources. In concrete terms, it covers infrastructure projects in Member States with a cross-border impact on the availability or quality of water resources. A planning, monitoring and evaluation manual was developed to capitalize on NBA's experiences in technical and financial programming. It now serves as a reference document for updating the operational plan and monitoring its implementation. The consultant's objective will be to operationalize this tool (both at the executive secretariat and at country level) and translate it into a computerized version using the MS Project software.
To this end, particular importance is attached to improving cooperation between the Executive Secretariat and Member Countries' National Focal Structures.
Financial programming:
The financial component of NBA programming has been enhanced since 2016 using a Programme Budget by Objective (BPO) approach. The BPO is a budgetary programme approach tool, which follows the idea of results-based management. The triennial planning is updated every year. Its gliding nature gives it a role as a regulator and adjuster of forecasts and achievements. It allows the analysis of resources and their allocation, according to the priorities expressed in NBA's strategic and operational plans.
The consultant will provide support in order to facilitate the further operationalization of the tool, based on the orientations given by the planning, monitoring and evaluation manual.
As part of the ‘financial programming’, the consultant will also support the NBA's Administrative and Financial Directorate with regard to the adaptation of accounting systems to the program approach.
