Bedingungen für die Teilnahme
Befähigung zur Berufsausübung:

Self-declaration that there are no grounds for exclusion according to §§ 123 and 124 of the German Act against Restraints of Competition (GWB). This as well refers to a bidding consortium and in cases of loans of elegibility, to a third-party company.

Wirtschaftliche und finanzielle Leistungsfähigkeit:

1) Self-declaration on compliance with the statutory minimum wage;

2) Submission of a current credit report (no older than 6 months), e.g. from credit reform; if the financial criteria show that the company is to weak, this could lead to exclusion;

3) Completed bidder questionnaire.

All points listed under this Section III.1.2) are minimum requirements.

Technische und berufliche Fähigkeiten:

1) Self-declaration that ISO 9000 certification or comparable is available;

2) Submission of an explanation of the quality system in the company (max. 4 pages);

3) Self-declaration that there are contact persons available who can communicate in English and German at B2 level while the framework contract is in place;

4) For lot 1: Delivery of composite insulators as well as crossarms;

5) For lot 1: Type tests carried out in the past for both composite insulators and crossarms. The reports of at least one type test for composite insulators and crossarms for min. 380 kV must be submitted.

All points listed under this Section III.1.3) are minimum requirements.

1) Cover letter containing at least the turnover and employee details, in addition to indicating what lots the application refers to:

2) Declarations/evidence relating to III.1.1) Notice, then one after the other relating to 1., 2. etc.;

3) Declarations/evidence relating to III.1.2) Notice, then one after the other relating to 1., 2., etc.;

4) Declarations/evidence relating to III.1.3) Notice, then one after the other relating to 1., 2., etc.;

5) If applicable, declarations on loans of eligibility/subcontractors (see below; VI. 3) c) (5);

6) If applicable, bidding consortium declaration (see below; VI. 3) c) (4);

(b) the request to participate must be submitted completely in German or English in electronic form via the Vergabekooperation Berlin website.

References: a bidder’s reference details are evaluated in an overall appraisal and awarded points.

A maximum of 100 points is awarded per bidder. The range of experience which is identifiable from the reference details and must be comparable with the requested service is evaluated. 100 points indicate an excellent range of experience, 90 points a very good one, 80 points a good one, 70 points a satisfying one and 60 points and less an insufficient range of experience. A bidder must therefore score a minimum of 70 points to be invited to submit a tender. The client reserves the right to invite only the best 3 to 6 bidders in a ranking list to be created to submit a tender. It also reserves the right to increase the number of bidders to be invited to submit a tender up to a maximum of 8 if there are appropriate grounds for doing so and if the minimum number of points has been reached in any case.

Continuation of point III.1.4) 'Objective rules and criteria for participation’:

1) 'Current’ means no older than 6 months retroactively from the participation period’s date of expiry;

2) If a bidder cannot produce a third-party certificate (e.g. a register entry) as required, a comparable third-party certificate shall be submitted and the comparability demonstrated by means of an appropriate explanation;

3) Foreign bidders: in principle, they must submit the required declarations/evidence in English or as an officially certified translation. If a declaration/evidence cannot be provided at all, this must be justified, a comparable explanation/evidence must be submitted and an explanation given as to why there is comparability. In justified cases, a German translation may be used.

4) Bidding consortia: together with the request to participate, they must submit a legally binding, fully filled-out bidding consortium declaration signed by all members. In particular, the aspect whereby the bidding consortium is formed in compliance with antitrust law must be taken into account.

Each member of the bidding consortium must submit the declarations and evidence required under III.1.1) and II.1.2). This applies to a limited extent to the declarations and evidence under III.1.3) if the bidding consortium intends to share tasks and, for example, insofar as certain references can only be submitted by one member of the bidding consortium; the bidding consortium must provide an exhaustive explanation of any limited submission of declarations and evidence in an annex to the bidding consortium declaration. The same rules apply to both bidding consortia and bidders.

5) Other companies: bidders can use other companies to prove their eligibility (loans of eligibility). The other company then has to submit a declaration of commitment according to which it will provide the bidder with a specifically defined partial service in the event of a contract being awarded. Companies that provide the bidder with loans of eligibility (eligibility lenders and subcontractors) as well as those other companies that the bidder would also like to include for the performance of the service (subcontractors) must be grouped together in a list outlining the other companies’ names and registered offices and the part of the service the other companies are intended for. As far as reasonable, the name and proof of availability of the subcontractor must be presented in the application.

VI. 3) Additional information:

(a) questions and answers: interested companies can contact the awarding body until 7 days before the end of the application deadline via message over the tender platform. If answers are of general interest, they will be sent anonymously to all participants. All interested companies are obliged to consider these clarifications within their application. Non-compliance can lead to exclusion;

(b)tender documents: contract notice and simultaneously retrievable tender documents provide a full bases in the sense of the legislator, in order to facilitate interested companies the decision over the participation on the tender (see justification to § 41 SektVO).

1) The applicant became aware of the claimed violation of public procurement provisions before filing the application for review, but did not complain to the client within a time limit of ten calendar days; the expiry of the time limit under § 134 (2) of the German Act against Restraints of Competition (GWB) remains unaffected;

2) Violations of public procurement provisions which become apparent from the tender notice are not notified to the client by the end of the time limit for the application or the submission of a tender specified in the notice;

3) Violations of public procurement provisions which only become apparent from the procurement documents are not notified to the client by the end of the time limit for the application or the submission of a tender specified in the notice;

4) More than 15 calendar days have expired since receipt of notification from the client that it is unwilling to redress the objection.’
