Submission of balance sheets or extracts taken from the balance sheets as well as submission of profit and loss statements of the past 3 closed business years, if the publication of these documents is mandatory according to the laws of the state, where the bidding company is based. Provided that these documents are published in the internet, the internet sources (URL) have to be stated.

Proof of a business liability assurance with an appropriate amount of coverage regarding the total contract value of this open procedure or a statement of an assurance company that, in case of acceptance of the tender, the assurer will close an assurance contract with the contractor.

Technische und berufliche Fähigkeiten:

A list of at least 3 projects within the past 10 business years in proof of producing glass in the fields of radiation protection windows or comparable products being delivered to buyers from public or private sectors. The references have to mention the contact person of the contract. In case, that the reference(s) do(es) not match the demands of radiation protection windows or has led to serious problems during the production or within the warranty period, the offer will be excluded. Confidentiality is granted.

Proof that the required manufacturing capacity is available in house.

Proof of a quality management system, e.g. by submission of a certificate according to DIN EN ISO 9001.

The requirements (see specification document) with regard to their usage have to be guaranteed according DIN 25420-3:2015-03 or equivalent. Any equivalent indicated by bidder needs to be examined and confirmed by the awarding authority in written first.

In connection with the initiation of a judicial review of tendering procedures the following legal requirements have to be considered:

§ 134 (GWB) Duty to inform and wait:

According to this paragraph a contract can be concluded not before 15 calendar days after mailing the information concerning the sourcing decision to all the bidders, who could not be considered. If the information concerning the sourcing decision will be sent to the not considered bidders by fax or electronically, this deadline will be shortened by 5 calendar days.

§ 160 (GWB) Initiation, application:

The application for initiating a judicial review is inadmissible, if:

1) The applicant already noticed the reprehended violation of public procurement regulations during the award procedure but did not notify the violation towards the awarding authority without delay;

2) Violations of awarding regulations already become recognizable by reason of the award notification, but are not reprehended towards the awarding authority until the announced expiration of the deadline for applications or filing of the bids at the latest;
