1) Please confirm that no application has been made or opened for an insolvency procedure or an equivalent procedure regarding your company, nor has the opening of such proceedings been declined due to insufficiency of assets, nor is your company in the process of liquidation, nor has it ceased its activities (Section 124 (1), No. 2 GWB).

2) Please confirm that within the last three years, no person at your company belonging to our administrative, management or supervisory boards or with powers of representation, decision-making or control, has been found guilty of committing one of the following offences and that your company itself has not been issued with a fine (in Germany §30 of the Act on Regulatory Offences (OwiG)) because of these offences (corresponds in Germany to the catalogue of offences in § 123 (1) of the Act against Restraints on Competition (GWB)).

5) Please confirm that with regard to the declarations and supporting documents required of your company, no inaccurate declarations relating to grounds for exclusion or selection criteria were made in the tendering procedure, neither was information withheld; we are aware that the submission of such false declarations and supporting documentations can lead to the exclusion from the tendering procedure/awarding of contract (cf. Technische und berufliche Fähigkeiten:

13) The dedicated ports for the offshore windfarm Baltic 1 are Barhöft (base port) and Rostock (on special occasions or in special circumstances).

The dedicated ports for the offshore windfarm Baltic 2 are Klintholm (base port), Rostock and Sassnitz (on special occasions or in special circumstances).

Please confirm that these ports are usable for the offered vessels.

14) Please confirm that proposed vessels will be able to:

- access the OSS of BALTIC 1 (Height of Ice Cone 3,5 m above msl)

- access the OSS of BALTIC 2 (Overhang of Topside at 11m air draft)

- access all boatlandings of Turbines (BALTIC 1: SWT 2,3-93 on Monopile), BALTIC 2 (SWT 3,6-120 on Monopile and 3-Leg-Jacketts)

15) Please confirm that at all times the Crew (at least Master + one member of the crew) of each CTV of the Bidder has a good mastery of the German language (level B1 of the Goethe Institut, respectively the Common European Framework of Reference for Languages (CEFR) is the minimum requirement), both in the spoken and in the written language. The certificate/proof about the command of the language (level B1) shall be initially delivered not later than at the start of the contract period and with each crew change consecutively.

16) Please confirm that the offered vessels fulfill all requirements of deployment in the operations areas, including class requirements. No vessel shall be accepted without "Certificate of Equivalence" / "Gleichwertigkeitsbescheinigung" of German BG Verkehr, which shall be provided with the submission of the bid.

17) Please provide an overview about the current fleet of your company.
