The objective of the MoKA project is the erection of a biomass fired district heating plant with a production capacity of 90 MWthermal .The newbuilt plant shall replace the existing coal fired plant of the cogeneration plant in the “Heizkraftwerk Moabit” site which is located in 13353 Berlin, Friedrich-Krause-Ufer 10-15.

The biomass shall be transported to the plant by ship, by train and eventually by truck.
The integration and erection of the newbuilt plant in the restricted space on a former coal yard next to operating plants in Moabit is a significant challenge for this particular project. The newbuilt plant shall be operated from the existing control facilities and will be connected to the existing district heating infrastructure on site.

Currently, the permit application is under preparation by Vattenfall.
The project will be awarded in 3 main lots:

Lot 1: Boiler island
Lot 2: Fuel Logistics
Lot 3: Civil works for lot 1 & 2 (not part of this announcement!)

It is planned to tender lots 1 and 2 in English and with a bespoke contract based on FIDIC agreements.
The contracting entity reserves the right, when assessing tenders, to look favourably on putative bids for both lots, if this results in a general discount and/or the assumption of responsibility for interfaces on the part of the bidder ("super lots"). However, the contracting entity is not obliged to do so.

Lot 1 includes boiler, flue gas treatment, flue gas condensation (or other measurements to optimize efficiency), ash handling & storage, piping (incl. district heating), chimney(s), secondary steel construction for platforms, water and sewage systems including the power supply 200V-10kV and a 110kV/10KV-transformer. The power and utility supply for the logistics lot (Lot 2) shall be part of lot 1.
The contractor is in charge of engineering, purchasing, construction & commissioning of its scope. The entire system must be certified with CE conformity. The execution of lot 1 shall be completed in one phase while the logistics lot (lot 2) shall be executed in 2 phases.
The biomass fuel consists of short-rotation coppices, landscaping material & forest residues (P63).
The boiler island shall have a thermal output of 90 MW. The plant shall be operated via an existing control room. The emissions of the plant shall meet the lowest BREF limits.
The erection of the boiler island takes place next to an existing coal yard, the construction and commissioning will thus be in a brown field situation.
The commissioning of phase 1 is currently scheduled for Q4 2025.

Lot 2 comprises the on site fuel handling of the newbuilt biomass plant. It includes the optimization of the existing biomass ship unloading, conveying and storage facilities and the connection of these systems with the newbuilt biomass plant (lot 1) by suitable conveying systems in the first phase of the project. In the second project phase, an additional biomass storage bunker, a train unloading system, an upgrade of the existing ship unloading crane from coal to biomass handling and all the connecting conveying systems (train and ship to new storage facility, new storage facility to biomass plant). The electrical distribution (200V – 10kV) for the equipment within lot 2 is part of the scope. The plant shall be operated via an existing control room. The supporting steel structures and enclosures of conveying systems are part of the scope.

A. Formalities applying to tenders 1. The bid must be submitted in English and in written form electronically at: https://root.deutsche-evergabe.de/portal/. Use of the portal deutsche-evergabe.de is free of charge for applicants and bidders of Vattenfall projects. Requests to participate can be submitted there. Requests to participate by post, fax or e-mail will not be accepted. 2. All supporting documents of compliance with the Conditions of Participation must be uploaded to the appropriate location (“Own Attachments” section) with a descriptive file name for easier verification. The corresponding file names should start with "Reg_" (Reg_ = respective register), contain abbreviations for content and company, be 60 characters long and not exceed 20 MB in size. (Example: "Reg_A_UN-Present_Fa_XXXXXXXXXX_2021_XX_XX"). The application must be submitted according to the numbering in Section III.1. structured and must contain the requested information in the respective sections. The awarding authority reserves the right not to consider information contained in the relevant headings. References to earlier applications are not sufficient to provide evidence. 3. The term "current" in Section III.1. means that the date of issue of the third-party confirmation in question must not be longer than 6 months prior to the date of publication in the Official Journal of the EU. 4. The obligation to submit third-party confirmation does not apply if and insofar as no such register is kept or registration is unnecessary. The onus is on the applicant to prove and explain this. 5. For the purposes of Point 4 above, foreign applicants are still required to submit such third-party confirmation. Their equivalence must be proven. To this end, exhaustive presentation is expected. It should be pointed out here that the entire tender must be written in English, including the respective evidence and annexes. If an official document, reference information, etc. are not written in English or German, a literal translation by a sworn translator must be submitted. 6. Even as part of a bidding consortium, an applicant may rely on the capabilities of other companies in proving their fitness: . a) Bidders wishing to avail themselves of such borrowed capacity (not possible for reliability in accordance with Section III.1.1.), must immediately name the subcontractors whose capacity they are borrowing and submit the relevant evidence for Sections III.1.1. to III.1.3. for the subcontractors together with the request to participate, this submission requirement being limited to the part of the services to be provided by subcontractors. In this case, the applicant must prove that the subcontractor will provide him with the necessary resources (e.g. in the form of a letter of commitment). b) Any other subcontractors (whose capacity is not borrowed) need not be named in the request to participate initially and the proof in accordance with Sections III.1.1. to III.1.3. need not be submitted initially for the subcontractor. The proportion contracted out alone has to be indicated. However, the contracting entity reserves the right to require other applicants/bidders who are shortlisted for further participation in the process and plan to use subcontractors, before the end of the competitive bidding or throughout the rest of the process, to name such subcontractors and to submit the aforementioned evidence in respect of their share of the services. 7. The contracting entity reserves the right – without being required to do so – to demand declarations and evidence (including for the minimum requirements) at a later date. Moreover, the contracting entity reserves the right to demand a personal introduction to an applicant or to inspect the applicant's business or a reference project, e.g. in order to verify the validity of the self-declarations. The applicant is not entitled to make any additional demands or demand a personal introduction. 8. The contracting entity reserves the right – without being required to do so – following the selection of applicants and submission of tenders, if the situation so justifies, to carry out an audit of individual bidders in the form of sustainability risk assessments. Justification for this includes a situation where the bidder is based in a CSR high-risk country or its production facilities are situated there. A list of high-risk countries can be found under: "CSR Country risk classification“ http://corporate.vattenfall.de/uber-uns/beziehungen-zu-lieferanten/ If it is discovered in the course of such an audit that self-declarations issued by the bidder in the course of the tendering process are inaccurate, the contracting entity is entitled to exclude the bidder from further competition. 9. The contracting entity reserves the right to exclude applications which do not meet the minimum requirements and/or deadlines from the further process, without further checks. 10. By submitting the request to participate, the applicant declares that they agree to a change of contracting entity. The possibility cannot be ruled out that a different company may become the contracting entity in the course of the tendering process. 11. Questions are to be submitted exclusively via the eVergabe question-and-answer tool. The contracting entity will endeavour to answer promptly. 12. If and to the extent to which it is permitted by law, qualification criteria may also be demonstrated using a standard European self-declaration. 13. The applicant – or in the case of bidding consortia, each individual member – is required to sign a non-disclosure agreement; The applicant should use the form available from the contact point (see Point 1.1 of the notice) for this purpose. B. Tendering process and specifications for the awarding of contracts The specifications for the tendering process can be found in the call for tenders. In the interests of ensuring maximum transparency, the contracting entity will nevertheless announce a number of general guidelines in advance, which cannot be required to be complied with and are therefore subject to clarification and change within the context of the call for tenders: 1. In the case of tenders to be submitted subsequently, which - based on the award criteria - prove to be significantly inferior to the competition financially speaking, following the submission of the tenders, the contracting entity may decide to exclude the bidder in question from further negotiations (elimination). 2. The awarding of contracts is subject to approval by the boards of the contracting entity. 3. The awarding of contracts is subject to existing official permits. 4. The awarding of contracts is subject to the performance of the services on economically feasible terms, to be established by the contracting entity. 5. Since the procurement project “Moabit Coal Phase Out” as a whole is of great importance for the functioning of the community and the complete publication of the documents would allow conclusions to be drawn about the functioning of critical infrastructure systems, the client refers to §§ 5 para. 3, 41 Para.4 SektVO to maintain confidentiality and secrecy, and will only provide those bidders in the bidding process with further information about the project who have proven in the preceding participation competition that they are able to provide the required services (aptitude test ). 7 . Based on the requested information, the awarding agency will conduct a credit check to determine the applicant's financial and economic capability. The applicant is considered financially capable if the credit check indicates that the applicant company is financially sound and large enough in relation to the value and term of the contract to meet all contract obligations. For this purpose, the applicant must have, among other things, adequate profit margins and sufficiently strong operating cash flows, as well as adequate capitalization with a generally acceptable (low) debt-to-equity ratio. In addition, the applicant's size and financial profile must be commensurate with the value of the contract and there must be a positive outlook that the applicant can maintain its financial suitability during the term of the contract.

Register O) [MINIMUM REQUIREMENT]
For the successful implementation of the intended contract, the applicant is required to have a thorough experience with equivalent scope (see II.1.4. und II.2.,i.e. size, complexity, fuel, location) and project size.
As proof of applicant’s professional competence, the Applicant shall submit at least three separate reference projects relating to services similar to those covered by the lot for which he is applying.
The earliest reference shall be commissioned not earlier than 1st January 2007, while the latest reference shall not be commissioned after (later than) the 31st May 2022.
The following information is to be provided for each reference:
Project name, place, contracting entity, date of award of contract, initial value of contract* and final billing amount*, Idea of the size and volume of the project:
a) An explanation of the technique and key technical data (size and capacity of the plant, fuel details, Interfaces),
b) An explanation of the contractual structure*
c) Details of the main services,
d) An explanation of the HSE measures taken specifically for biomass and/or waste wood* and
e) an explanation of the commissioning set-up and execution.*

The initial agreed project planning, events which threatened the project execution and mitigating measures taken by applicants organisation to reduce the risks of extended time & costs for the contracting entity*.

Vattenfall entity is entitled to take into account their own experience with the applicants in similar projects (additionally in the case of lots: the lots tendered for). If negative experiences demonstrably exist, the contracting entity may invite the applicant to a face-to-face meeting to discuss the situation. If the applicant is unable to demonstrate their fitness in the course of this meeting, despite the contracting entity's own bad experiences, the contracting entity is entitled to rule out the applicant as unfit.

Proof of the introduction and implementation through procedures of a quality management system in accordance with the DIN EN ISO 9001 series by means of valid certificates. Alternatively, proof is to be provided of implementation of a similar quality management system.

Every applicant must achieve a minimum score of 30% in order to be allowed to continue with the tendering process. a) The Applicant’s staff´s responsible for the coordination and implementation of the contract have to master the English language.
b) The staff´s responsible for project execution should sufficiently master the English language, both in word as writings.

c) On-site work supervisors shall speak und understand English fluently.
d) The permit application will be provided in German language. The Applicant shall ensure that his staff understands the content of the permit application in its entirety.

The applicants for lot 1 and for lot 2 have to fill in the engineering questionnaire. Applicants applying to both Lot 1 and Lot 2 need only fill in the questionnaire once. The questionnaire is available from the contact point (see section I.1)).
The answers are no minimum requirements for both lots. However, the awarding authority has specified in table 2 of the questionnaire how it will assess the answers in an overall assessment of the suitability of the applicants within the limits of its discretion. The awarding authority has made it clear to the applicants by means of a green marking what they expect from a suitable applicant as proof.

The awarding authority reserves the right to verify the information from the questionnaire for suitable applicants in a second stage by means of an on-site audit of the applicant. However, there is no obligation to carry out the audits.

A. Formalities applying to tenders
1. The bid must be submitted in English and in written form electronically at: https://root.deutsche-evergabe.de/portal/.
Use of the portal deutsche-evergabe.de is free of charge for applicants and bidders of Vattenfall projects.
Requests to participate can be submitted there.
Requests to participate by post, fax or e-mail will not be accepted.
2. All supporting documents of compliance with the Conditions of Participation must be uploaded to the appropriate location (“Own Attachments” section) with a descriptive file name for easier verification. The corresponding file names should start with "Reg_" (Reg_ = respective register), contain abbreviations for content and company, be 60 characters long and not exceed 20 MB in size.

The application must be submitted according to the numbering in Section III.1. structured and must contain the requested information in the respective sections. 3. The term "current" in Section III.1. means that the date of issue of the third-party confirmation in question must not be longer than 6 months prior to the date of publication in the Official Journal of the EU.
4. The obligation to submit third-party confirmation does not apply if and insofar as no such register is kept or registration is unnecessary. The onus is on the applicant to prove and explain this.
5. For the purposes of Point 4 above, foreign applicants are still required to submit such third-party confirmation. Their equivalence must be proven. To this end, exhaustive presentation is expected. It should be pointed out here that the entire tender must be written in English, including the respective evidence and annexes. If an official document, reference information, etc. are not written in English or German, a literal translation by a sworn translator must be submitted.

6. Even as part of a bidding consortium, an applicant may rely on the capabilities of other companies in proving their fitness: .
a) Bidders wishing to avail themselves of such borrowed capacity (not possible for reliability in accordance with Section III.1.1.), must immediately name the subcontractors whose capacity they are borrowing and submit the relevant evidence for Sections III.1.1. to III.1.3. for the subcontractors together with the request to participate, this submission requirement being limited to the part of the services to be provided by subcontractors. In this case, the applicant must prove that the subcontractor will provide him with the necessary resources (e.g. in the form of a letter of commitment).

b) Any other subcontractors (whose capacity is not borrowed) need not be named in the request to participate initially and the proof in accordance with Sections III.1.1. to III.1.3. need not be submitted initially for the subcontractor. The proportion contracted out alone has to be indicated.

However, the contracting entity reserves the right to require other applicants/bidders who are shortlisted for further participation in the process and plan to use subcontractors, before the end of the competitive bidding or throughout the rest of the process, to name such subcontractors and to submit the aforementioned evidence in respect of their share of the services.

7. The contracting entity reserves the right – without being required to do so – to demand declarations and evidence (including for the minimum requirements) at a later date. Moreover, the contracting entity reserves the right to demand a personal introduction to an applicant or to inspect the applicant's business or a reference project, e.g. in order to verify the validity of the self-declarations. The applicant is not entitled to make any additional demands or demand a personal introduction.

8. The contracting entity reserves the right – without being required to do so – following the selection of applicants and submission of tenders, if the situation so justifies, to carry out an audit of individual bidders in the form of sustainability risk assessments. If it is discovered in the course of such an audit that self-declarations issued by the bidder in the course of the tendering process are inaccurate, the contracting entity is entitled to exclude the bidder from further competition.
9. The contracting entity reserves the right to exclude applications which do not meet the minimum requirements and/or deadlines from the further process, without further checks.
10. By submitting the request to participate, the applicant declares that they agree to a change of contracting entity. The possibility cannot be ruled out that a different company may become the contracting entity in the course of the tendering process.

11. Questions are to be submitted exclusively via the eVergabe question-and-answer tool. The contracting entity will endeavour to answer promptly.
12. If and to the extent to which it is permitted by law, qualification criteria may also be demonstrated using a standard European self-declaration.
13. The applicant – or in the case of bidding consortia, each individual member – is required to sign a non-disclosure agreement; The applicant should use the form available from the contact point (see Point 1.1 of the notice) for this purpose.
B. Tendering process and specifications for the awarding of contracts
