The aim of this tender is to find a company in the field of building protection specialized for the entrance control of the Swiss Embassy in Berlin, for the period from 01/06/2023 to 31/05/2028 for 5 days (41 h/week) during the opening hours of the representation. The object to be protected is a diplomatic mission consisting of a single building with a garden at the back of the building. The security operation is carried out unarmed.

The scope of services includes:

(a) access control during opening hours and on occasions (control with baggage checking machine and/or hand probe (metal detector), visual control of bags). Switching on the burglar alarm system in the evening.

b) Security - prevention of unauthorized access to compound/garden - during major events, construction work, etc. in the building and garden.

c) Daily round around the building (outside). Monitoring of the video surveillance system (live pictures).

Essential requirements:The contracting authority may only award public contracts for the supply of goods, work and services in Switzerland to tenderers that ensure compliance with the workplace health and safety regulations and the terms and conditions of employment applicable at the place of performance, the notification and authorisation duties under the Federal Act of 17 June 2005 on Measures to Combat Illegal Employment (IEA) and the provisions on the equal treatment of men and women in terms of equal pay (see Art. 12 para. 1 PPA). For goods, work or services to be supplied abroad, the tenderer must, as a minimum, ensure compliance with the Core Conventions of the International Labour Organization as set out in Annex 6 PPA (see Art. 12 para. 2 PPA). Accordingly, the contracting authority may only award a public contract to tenderers that, as a minimum, comply with the legal provisions on the protection of the environment and the conservation of natural resources applicable at the place of performance (see Art 12 para. 3 PPA in conjunction with Annex 2 PPA). Any subcontractors that are permitted must meet the requirements set out in Article 12 paras. 1–3 PPA. These obligations must be incorporated into the agreements between tenderers and subcontractors.

Additional information: The contract is concluded subject to the prior approval of credits by the FDFA. The English publication is a translation. In case of differences or discrepancies, the German version shall prevail.

Procedures for appeal:In accordance with Article 56 paragraph 1 of the Public Procurement Act (PPA), a written appeal against this decision can be lodged with the Federal Administrative Court, P.O. Box, 9023 St. Gallen, Switzerland, within 20 days of notification. Any appeal is to be submitted in duplicate and must include what is being sought, the grounds for appeal, evidence and the signature of the person lodging the appeal or his or her representative. A copy of this decision and available evidence must be included. The provisions of the Administrative Procedure Act (APA) on legal holidays do not apply in accordance with Article 56 paragraph 2 of the PPA. Based on Article 52 paragraph 2 of the PPA, the appeal can be used only to establish that this decision violates federal law, but not to apply for its cancellation. Foreign providers are permitted to appeal only to the extent that the state in which they are domiciled grants reciprocal rights. .

The contracting authority reserves the right to award subsequent mandates to the successful tenderer of this tender procedure if a change of tenderer for goods, work or services to replace, supplement or extend supplies already provided is not possible for economic or technical reasons, would cause considerable difficulties or would entail substantial additional costs.
