FMS Wertmanagement Service GmbH (‘FMS-SG’) is a wholly-owned subsidiary of FMS Wertmanagement AöR (‘FMS-WM’), an organizationally and economically independent institution under public law with partial legal capacity within the Financial Market Stabilization Authority (FMSA) in Germany. As of 1.10.2010, FMS-WM assumed risk positions and non-strategic divisions from Hypo Real Estate Holding AG in Germany and abroad for the purpose of ultimately stabilizing the HRE group and the financial market and will settle these in accordance with economic principles. FMS-SG assumed management of the portfolio of FMS-WM since 1.10.2013. 1 of its branches is at the Dublin location from where it performs a part of the servicing.

The present invitation to tender is organized by FMS-WM on behalf of FMS-SG. FMS-SG intends to cover part of its recruitment requirements in Dublin arising in in connection with the management of the portfolio through the means of recruitment agencies.

The procurement documents consist of the procedural conditions including the suitability and award criteria and their weighting (Procurement Document A), the service description (Procurement Document B), the forms to be used for submitting an offer (Procurement Document C) and the draft of the framework agreement ( Procurement Document D). The contract will be awarded by way of an open procedure, as defined in section 119 paragraph 3 GWB, Germany's Act Against Restraints on Competition and section 15 VgV, Germany's Regulation on the Award of Public Contracts. FMS-WM will procure the services for the benefit of FMS-SG.

FMS-WM reserves the right to define more precisely or change the published course of the procedure in a transparent manner based on equal treatment of all bidders.

The contracting authority will select two entities per lot as framework agreement partners. FMS-SG will conclude framework agreements with the two companies that have submitted the most favourable offers per lot as ranked by the award criteria. The framework agreements will then be established for a term of four years starting with the official award date.

The contracting authority will be working exclusively with the two framework agreement partners in each lot. For each recruitment demand both framework partners will be assigned with the recruitment in accordance with the framework agreement.

If single recruitment assignments under these framework agreements are commenced before the effective end date of the agreements, but the tasks are required to be performed beyond this date, these single recruitment assignments are not affected by the end of the term of the framework agreements.
