Forschungszentrum Jülich GmbH will act as the procuring entity. As a consequence, the HBP PCP will be regulated by German national public procurement legislation. This PCP procedure is articulated in 2 stages: — The 'Tendering Stage' - Bid submission and admission based on participation requirements, feasibility study and financial offer; — The 'Execution Stage' – this stage is divided in three different Phases: — Phase I (solution design) — Phase II (prototype development) — Phase III (Pre-commercial small scale product/service development) In compliance with the phased nature of the Pre-Commercial Procurement model the number of suppliers decreases from one phase to the next in order to select the suppliers that best address the technical challenge on which the PCP is based. A maximum number of five (5) tenderers will be awarded a phase contract for phase I. A minimum of three (3) tenderers will be awarded a phase contract for phase II and a minimum of two (2) tenderers will be awarded a phase contract for phase III. See Tender Regulation. To enter in this PCP, economic operators must register via a specific form at the procuring entity web site: http://apps.fz-juelich.de/hbp-pcp Upon registration with a username and a password it will be possible to access the secure web site where the documents, agreements and forms related to the PCP are stored. The tenders must be submitted in accordance with the directions provided by the ‘HBP PCP Tender Regulation' available in the above mentioned website. Applications must be sent exclusively to the address stated therein. Please note that the last date to register in order to get access to the secure web site and the tender documents is seven (7) working days prior the deadline for tender submission. Any question or request for clarification should be sent in writing by email to the procuring entity tender e-mail address provided in section 1.5.2 in the Tender Regulation. This PCP receives funding under the European Union's FP7 research programme under the grant agreement “Human Brain Project” [grant agreement number 604102]. However the EU is not participating as a contracting authority in this procurement.

Premises of the tenderer in the EU (for specific localization requirements see the technical requirements document at information URL in section I.1). At the end of the project the tenderer is expected to produce a prototype which shall be delivered and tested at the site of Forschungszentrum Jülich GmbH. For the purpose of VAT and within the EU, R&D services are deemed to be delivered at the premises of the beneficiary of such services.

- the services provided during the past three years are relevant in the context of this PCP and the aggregated total value exceeds EUR 100 000 excl. VAT;
- the aggregated manpower involved in relevant R&D for the last three years exceeds nine (9) person years.

The PCP is carried out under the explicit exemption for R&D services set out in article 16 (f) of Directive 2004/18/EC of the European Parliament. Tenderers are asked to observe that the object of the procurement thus is restricted to cover R&D services and not products or other supplies, or commercial development activities and that these R&D services are not already financed otherwise.

While the HBP PCP tender procedure implements the PCP procedure set out by the EC, it will be carried out under German law. The relevant German public procurement legislation comprises the GWB , the VgV and the subordinate second chapter of the VOL/A . The GWB and VgV implement EU Directives 2004/17/EC and 2004/18/EC. A specific exemption contained in the GWB means that, in principle, its provisions do not apply to the HBP PCP. However, German public budget law requires that public contracts exempted from provisions of the GWB should, nevertheless, respect general principles of economy, effectiveness, impartiality, equal treatment, transparency and proportionality. In addition, the general administrative provisions of the Federal Budget Code, § 55 VV-BHO , require to apply the first part of the VOL/A, as well as VOL/B. Nevertheless, the VOL/A is not deemed to be part of the contract and gives no right to the Tenderers to legally enforce compliance with these provisions. The HBP PCP is therefore subject only to these general principles of public procurement.

Further provisions which may be set out in the GWB only apply when specifically mentioned in the Tender Documents. If such provisions refer to legal instruments other than the GWB, these will be mentioned explicitly in the Tender Documents, including its Annexes. The fundamental Treaty principles according to the Court's case-law to Articles 49 and 56 TFEU , in particular with respect to the principles of equal treatment, non-discrimination, and equal opportunity of all tenderers as well as the obligations of transparency and publicity will be applied. Since the GWB is exempted from the HBP PCP, the German law only grants the ability to sue a claim for compensation with respect to breaches of public procurement legislation.
