1) Candidates must declare the absence of the exclusion grounds stated in § 123 GWB et seq. of the Act against Restraints of Competition (Competition Act — GWB). For this purpose the form ‘I.2.7 — Declaration on exclusion grounds’ must be used; 2) Economic operators may rely on the capacities of other entities, regardless of the legal nature of the links which it has with them. Every third party whose capacities the candidate refers to must complete the form ‘I.2.3 — Declaration on third parties capacities’ and submit it with the request to participate. In addition, that third party must prove its economic and financial standing, its technical and professional ability in accordance with the requirements of the contract notice and the forms provided to the extent that the candidate so relies on it. The third party to whose capacities the candidate refers to must also be able to prove individually and completely its suitability to pursue the professional activity and the absence of the grounds for exclusion specified in § 123 et seq. GWB in accordance with the contract notice and the forms provided. A candidate may only use the capacities of other companies to provide the required technical and professional ability if those other companies provide the service for which those capacities are needed. The contracting authority will examine if the third-party whose capacities the candidate refers to meets the relevant selection criteria and if there are grounds for exclusion. If the third-party does not fully meet the appropriate selection criteria or if there is are mandatory grounds for exclusion (§ 123 GWB), the applicant must replace this third party company. The contracting authority has the right to request the replacement of the third party company if there is an optional ground for exclusion (§ 124 GWB). The candidate will be granted a reasonable deadline to meet with the demand for replacement. 3) It is admissible to participate as a consortium. A consortium is treated legally like a single candidate or tenderer. Insofar as candidates or tenderers are mentioned in this contract notice or in the tender documents, this means both single candidates or tenderers and consortiums. In the request to participate, the members of a consortium have to appoint an authorized representative for the conclusion and the implementation of the contract by submitting the form ‘I.2.2 — Consortium Declaration’. The authorized representative will serve as single point of contact for the consortium in this procurement procedure. The suitability to pursue the professional activity must be proven individually for each member of a consortium by submitting the form ‘I.2.4 — Declaration suitability to pursue the professional activity’ and the absence of exclusion grounds stated in § 123 et seq. GWB by submitting the form ‘I.2.7 — Declaration on exclusion grounds’. The other selection criteria must be met by the consortium as a whole. Therefore each member must complete the forms ‘I.2.5 — Declaration on economic and financial standing’ and ‘I.2.6 — Declaration on technical and professional ability’ only to the extent that it applies to this member. Insofar as the capacities of a third party are used, the form ‘I.2.3 — Declaration on third parties capacities’ must also be completed and submitted. The contracting authority is the Humboldt Forum Foundation in the Berlin Palace. The Humboldt Forum Foundation, which was established by the Federal Government in 2009 by resolution of the Bundestag, is the builder, owner and later operator of the Humboldt Forum. It coordinates the interests of the stakeholders and, together with the Federal Office for Building and Regional Planning, manages the planning of the architects and specialist engineers and the execution of the construction work.

According to its statutes, the Humboldt Forum Foundation pursues exclusively and directly charitable purposes of promoting art and culture, education, international understanding and tolerance in all areas of culture, international understanding, as well as the protection of historical monuments and the preservation of historical monuments within the meaning of the section ‘Tax-privileged purposes’ of the tax code.

Actors in the Humboldt Forum are the Humboldt Forum Foundation, the Prussian Cultural Heritage Foundation with the Ethnological Museum and the Museum of Asian Art of the National Museums in Berlin, the Kulturprojekte Berlin GmbH, the Stiftung Stadtmuseum Berlin and the Humboldt University Berlin.

The Humboldt Forum is being created as a new cultural district in the rebuilt Berlin Palace in the centre of Berlin. It stands for an approach that brings together different cultures and perspectives and seeks new insights into current issues such as migration, religion and globalisation. The Humboldt Forum already offers an exhibition, mediation and event programme.

From September 2020, the Humboldt Forum will open in 3 stages. This will be completed by the end of 2021. Four permanent exhibitions will be shown in the fully open building: the Ethnological Museum and the Museum of Asian Art (Prussian Cultural Heritage Foundation — National Museums in Berlin), the Berlin Exhibition (Kulturprojekte Berlin GmbH and Stiftung Stadtmuseum Berlin) and the Humboldt Laboratory (Humboldt University Berlin). Special exhibitions, for which the Humboldt Forum will cooperate with various institutions, as well as an educational programme will complement the cultural and scientific programme. In addition, up to 1 000 events are to take place annually.

Parallel to the completion of the building, the Humboldt Forum Foundation has been developing the cultural operations of the Humboldt Forum in the Berlin Palace under the overall curatorial responsibility of the General Director since 2016.
Subject of the contract to be awarded are the follwing services:
— worldwide introduction of the brand ‘Humboldt Forum’ as a new and important cultural institution in the international cultural landscape as a tourist ‘must see’,
— on the basis of current local and national PR work, the service provider should build up an image that attracts a great deal of attention in the international public arena as well as coverage beyond the specialist cultural media.
Details of contractual services will be contained in the tender specifications, which will be made available to the candidates who successfully qualify in this call for competition.

Befähigung zur Berufsausübung:
1) Proof of entry (e.g. certificate or excerpt) in the trade register of the state in which the candidate is established. The proof may not be older than 6 months at the expiry of the time limit for the submission of tenders. If a candidate is not required to be registered in a professional or trade register under the law of the State in which he is established, he must make a self-declaration on this and on the reasons (e.g. the legal status). For the member states of the European Union, the respective professional or trade registers and the certificates or declarations of professional practice are set out in Annex 11 to Directive 2014/24/EU; if a proof of entry is issued only once according to the legal framework of the state in which the candidate is established it is admissible to submit an older proof under the condition that the circumstances are explained by the candidate.

2) Alternative proof: provided that the candidate is not registered in the trade register, alternative proof of suitability to pursue the professional activity (e.g. entry in a partnership or association register, membership in a business association).

Wirtschaftliche und finanzielle Leistungsfähigkeit:
1) Total turnover: annual turnover in EUR (net), based on the last 3 financial years before the end of the application period (2016, 2017, 2018);
2) Specific turnover: annual turnover in relation to the scope of the contract (communications and marketing services) in EUR (net) in relation to the last 3 financial years before the end of the deadline for requests to participate (2016, 2017, 2018);

3) Proof of a public liability insurance for activities that are the subject of this contract, for personal injury, damage to property and pecuniary loss. The proof must not be older than 6 months at the end of the deadline for requests to participate and must show the coverage amounts agreed with the insurance company. A commitment by the candidate to conclude a contract with an appropriate insurance cover in the event of a contract is sufficient proof.

Mindeststandards:
3) The public liability insurance must cover the following amounts any 1 event and 2 in the aggregate per year:
— personal injury: at least 1 000 000,00 EUR,
— property damage: at least 1 000 000,00 EUR,
— financial loss: at least 100 000,00 EUR.
Technische und berufliche Fähigkeiten:
1) Suitable references for previously executed contracts in the form of a list of the main services provided in the last 3 years before the end of the deadline for requests to participate, including the following information:
— description of the services provided, their nature, extent and difficulty, including an indication of the number of staff employed,
— order value in EUR (net),
— performance period,
— declaration on the performance of the services as contractor, subcontractor or member of a consortium,
— competent contact person with the client.
2) Declaration on the the average annual number of permanent employees of the candidate and the number of executives in the last 3 years before the end of the deadline for requests to participate (2016, 2017, 2018);
3) Subcontracting: indicate which parts of the contract the candidate intends to subcontract, if such a statement is already possible.
In order to submit the declarations required, the relevant section of the form ‘I.2.6 — Declaration of technical and professional ability’ must be completed and, if necessary, supplemented by separate annexes. Supplementary descriptions of referenced contracts should not exceed 2 A4 pages each.
