As space infrastructure touches almost every aspect of our daily lives, from navigation to communication to military capabilities, securing our infrastructure in space is vital. The vulnerability of space-based systems and the dependence on these systems require the development of additional capabilities. Responsive space capabilities provide the means to protect, repair, upgrade and replace important satellites in a matter of days. A mobile air-launch system can be deployed from a myriad of existing airports regardless of current system deployment locations and mobilized to rapidly launch a constellation of new satellites. DLR’s Responsive Space Cluster Competence Center (RSC³) has the intention to conduct an Air-Launch over the North Sea after taking off from a northern German airport in 2024, latest 2025. Several satellites with military and experimental payloads are intended to be launched into a Polar Low-Earth Orbit. It is planned to procure the launch capability from any commercial provider with the Launch services itself, including the carrier aircraft and the rocket.
II. The feasibility study as the subject of this tender:
The feasibility study as a technology Demonstration Preparatory Study advertised here must assess the options and requirements for managing and safely operating from a northern German airport/spaceport, including the ground support equipment, aircraft operations, regulatory conduct and other items that may be required. Furthermore, the study must examine various launch trajectories, rapid and responsive capabilities that may be unique to national security, and include an assessment of local and regional industrial base utilization. The Estimated total Cost of this Study is 250.000,- € for a 3-month effort. The effort must include at least two in-person workshops between the providers engineering team and RSC³ personnel. At least one location scouting trip to viable northern German airports must be conducted in person by a team of experts of the provider. The study shall ideally run in the second/third quarter of 2023.

In the second phase of the tender, the client plans to invite at least three and at most five applicants to submit a bid. Section 51 (3) VgV remains unaffected by this. The contracting authority therefore limits the number of suitable applicants who will be invited to submit a bid at a later date if more than five suitable applicants are available. For this purpose, suitability criterion A5 (references) is used again for an objective and non-discriminatory assessment and limitation of the number of suitable applicants. A maximum of 100 points can be achieved and it is evaluated as follows:
A) By the number of references listed in A5 that meet the minimum requirements. This number is rated with a maximum of 20 out of 100 points. The applicant(s) with the most references (maximum number of references) will automatically receive 20 points. The other applicants receive points according to the following procedure: (Respective number of references of the applicant / maximum number of references) x 20 = number of points achieved B) According to the highest payload in kg among the references given in A5 that meet the minimum requirements. This number is rated with a maximum of 30 out of 100 points. The applicant(s) with the highest specified payload in kg (maximum payload) will automatically receive 30 points. The other applicants receive points according to the following procedure: (Respective number of the highest payload of the applicant/ maximum number of payload) x 30 = number of points achieved C) According to the highest attained orbit of the payload in km among the references mentioned in A5 that meet the minimum requirements. This number is rated with a maximum of 20 out of 100 points. The applicant(s) with the highest achieved orbit of the payload in km (maximum number of kilometers) will automatically receive 20 points. The other applicants receive points according to the following procedure: (Respective highest achieved orbit in km of the applicant/ maximum number of kilometers) x 20 = achieved score D) By the number of most different named non-home station airports among the references named in A5 that meet the minimum requirements. This number is rated with a maximum of 30 out of 100 points. The applicant(s) with the highest number achieved (maximum number "non-home station airport") automatically receive 30 points. The other applicants receive points for the following procedure: (Respective number of different "non-home station airports" of the applicant / maximum number of "non-home station airports") x 30 = score achieved All points are summed up. The five applicants with the highest number of points will be asked to submit an offer. If several applicants are tied for fifth place, the “maximum payload” decides among them. If there are still several applicants with the same number of points in fifth place, the highest number of “non-home station airport” decides among them.

6. Indication of at least two references from the last three years (so since 2020 to 2022) that are comparable with this contract/ subject of the tender. The minimum requirements for each of the two references are: The provider must have successfully demonstrated a commercial Air-Launch capability by air-launching an orbital rocket with successful payload deliveries. These launches must have taken place within the last three years (meaning from 2020 to 2022). The reachable orbits of this Air-Launch capability must have been at least 400 km with 200 kg of payload. The here used Air-Launch capability must have been mobile, i.e. capable of taking off from a non-home station airport. The details of the names of the clients and the mission can of course be anonymized if this is required by existing agreements with the clients. But: Upon request, the bidder also submits the name of the clients and the contact details of this references at short notice. This serves to ensure that the information on the references can be checked in more detail if the awarding authority considers this to be useful. All information will of course be treated confidential in this case. Based on our experience, however, we do not expect that this will be necessary.

Only requests to participate should be submitted at this stage. Only the successful applicants, after the applications to participate have been evaluated, are actively asked to submit a binding initial offer in a second phase by the awarding authority. Only then will the bidders be provided with further details on the preparation of the offer. Within the framework of this second phase of the tender, i.e. the negotiation procedure, the contracting authority expressly reserves the right to award the contract in accordance with Section 17 (11) VgV to one of the first bids submitted without prior negotiation.
